ACCEPTANCE OF DONATIONS

3.42.010 Purpose.
The purpose of this chapter is to establish procedures for acknowledgment and acceptance of money donated, devised or bequeathed to the city of Fife pursuant to RCW 35A.11.040. (Ord. 2075 § 2, 2022).
3.42.020 Funds – Accounting.
The city of Fife’s finance department is responsible for providing for the deposit and financial administration of any donation to the city. If necessary, the finance department shall track the proposed use of any such donation and shall maintain separate records of accounts showing receipts and disbursements. The finance director may establish further rules and regulations for the accounting and administration of donations, consistent with this chapter, as deemed necessary by the city manager. 3.42.030 Acceptance of donations in general – Donor’s desired use or conditions.
The city has the discretion to accept or decline any proposed donation, whether conditioned or not, subject to the provisions of this chapter. In the event a department director has reason to believe a donation could cause or result in an appearance of impropriety, the department director shall consult with the city attorney prior to accepting the donation. Conditioned donations shall be assigned to a project or existing fund consistent with the donor’s desired use, as long as such condition(s) do not conflict with city, state or federal law, in which case the city shall ask that the condition(s) be removed or decline the donation. In the event the donor places mandatory requirements upon the use of the donation, in accordance with the acceptance authority below, the city may reject any and all donations if the required use of the funds cannot reasonably be achieved, or if the city will incur costs greater than $500.00 per year to administer the donation.
Donors who wish to make a donation to the city shall complete a donation agreement form. Staff should notify council of all accepted donations so that the donor’s generosity can be officially acknowledged by council. (Ord. 2075 § 4, 2022).
3.42.040 Monetary donations.
The city manager may accept monetary donations in amounts less than $5,000 and credit such amounts to the appropriate fund without specific approval of the city council. Monetary donations valued at more than $5,000 shall be accepted only by resolution of the city council which shall specify the municipal purpose or purposes for which such donations may be used. All monetary donations will be considered public funds once accepted by the city. (Ord. 2075 § 5, 2022).
3.42.050 Nonmonetary donations.
The city manager may accept nonmonetary donations in values less than $5,000 and credit such assets to the fixed asset inventory without further specific approval of the city council. Nonmonetary donations valued at more than $5,000 shall be accepted only by resolution of the city council. All nonmonetary donations will be considered public assets once accepted by the city.
