VEHICLE PROWLING

9.36.020 Determination of guilt.
9.36.010 Definition.
“Enters or remains unlawfully” means any person who enters or remains unlawfully in a vehicle of another when he is not then licensed, invited or otherwise privileged to so enter or remain. (Ord. 902 § 1, 1988).
9.36.020 Determination of guilt.
A person is guilty of vehicle prowling if, with the intent to commit a crime against the person or property therein, he enters or remains unlawfully in a vehicle of another. (Ord. 902 § 2, 1988).
9.36.030 Prosecution.
In any prosecution for vehicle prowling, any person who enters or remains unlawfully in a vehicle of another may be inferred to have acted with the intent to commit a crime against a person or property therein unless such entering or remaining is explained by evidence satisfactory to the trier of fact to have been made without such criminal intent. (Ord. 902 § 3, 1988).
