2.70.010 Municipal court.

There is established the municipal court of the city.  The court shall have such jurisdiction and shall exercise all powers vested in it pursuant to RCW Chapter 3.50, together with such other powers and jurisdiction as are generally conferred by the state of Washington by either common law or by express statutes upon such courts.  (Ord. 1041 (part), 1989)

2.70.020 Jurisdiction.

The municipal court shall have exclusive original jurisdiction over traffic infractions arising under city ordinances, and shall have exclusive original criminal jurisdiction of all violations of city ordinances, and shall have original jurisdiction of all other actions brought to enforce or recover license penalties or forfeitures declared or given by such ordinances or by state statutes.  The municipal court is empowered to forfeit cash bail or bail bonds and issue execution thereon; and in general to hear and determine all causes, civil or criminal, including traffic infractions, arising under such ordinances and to pronounce judgment in accordance therewith.  (Ord. 1041 (part), 1989)

2.70.030 Municipal judge—Qualifications—Appointment and term.

A.    The municipal judge shall be recommended by the city manager and appointed by the council.  The person appointed as municipal judge shall be a citizen of the United States of America and of the state of Washington, and an attorney admitted to the practice of law before the Supreme Court of the state of Washington.

B.    The term of office of the municipal judge’s office shall be determined by contract between the city acting through its manager and the appointed judge, provided that such term of office shall be consistent with RCW 3.50.040.  (Ord. 1041 (part), 1989)

2.70.040 Salary of the judge—Operating costs of court--Court employees.

A.    The salary of the judge shall be determined by contract between the city acting through its manager and the appointed judge, provided, that the city council shall approve the salary.

B.    All costs of operating the municipal court, including but not limited to, salaries of judges and court employees, dockets, books of records, forms, furnishings and supplies, shall be paid wholly out of the funds of the city.  The city shall provide a suitable place for holding court and pay all expenses of maintaining it.  (Ord. 1041 (part), 1989)

2.70.090 Court costs--Disposition of revenue.

A.    The provisions of RCW 3.50.100 are adopted and incorporated by reference.

B.    The following court costs shall apply to all cases arising from violations of city ordinances which are tried before the municipal court:

1.    Filing fee for criminal complaints, twenty-five dollars;

2.    Filing fee for traffic infractions, ten dollars;

3.    Witness fees and juror fees, ten dollars;

4.    Supplemental penalty for failure to pay penalty previously assessed, twenty-five dollars;

5.    Warrant fee, twenty dollars;

6.    Alcohol/drug fund, fifty dollars.  (Ord. 1041 (part), 1989)

2.70.100 Court sessions.

Regular court sessions for municipal court shall be every third Friday of every month commencing at eight-thirty a.m.  Special sessions may be called at the pleasure of the municipal court judge.  Municipal court shall not be open on city holidays.  (Ord. 1041 (part), 1989)

2.70.110 Change of venue.

No change of venue from the municipal court shall be allowed in actions brought for violations of city ordinances.  (Ord. 1041 (part), 1989)

2.70.210 Savings.

The enactment of this chapter shall not affect any case, proceeding, appeal or other matter pending in the Goldendale Municipal Department of the district court or in any way modify any right or liability, civil or criminal, which may be in existence on the effective date of the ordinance codified in this chapter.  (Ord. 1041 (part), 1989)

2.70.220 Emergency.

This chapter is necessary for the protection of public health, public safety or public peace, and is designated as a public emergency ordinance, and is therefore effective upon passage.  (Ord. 1041 (part), 1989)
