16.08.010 Purpose of chapter.

Definitions pertinent and appropriate to the enforcement of this title are hereby set forth as a matter of clarification for those instances where words or phrases may have a technical connotation not commonly understood or defined.  (Ord. 1259 §2(part), 1999)

16.08.020 Administrator.

“Administrator” means the mayor or designated representative who is vested with the duty of administering subdivision and platting regulations within the incorporated areas of Goldendale.  (Ord. 1259 §2(part), 1999)

16.08.030 Alley.

“Alley” means minor way used primarily for vehicular and pedestrian access to the back or side of properties otherwise abutting on a street, and not intended for general travel.  (Ord. 1259 §2(part), 1999)

16.08.040 Binding site plan.

“Binding site plan” means a drawing to a scale specified by local ordinance which:  (a) Identifies and shows the areas and locations of all streets, roads, improvements, utilities, open spaces, and any other matters specified by local regulations; (b) contains inscriptions or attachments setting forth such appropriate limitations and conditions for the use of the land as are established by the local government body having authority to approve the site plan; and (c) contains provisions making any development be in conformity with the site plan.  (Ord. 1259 §2(part), 1999)

16.08.050 Block.

“Block” means a lots, tracts or parcels within well defined and fixed boundaries.  (Ord. 1259 §2(part), 1999)

16.08.060 Building line.

“Building line” means a line extending across the full width of a lot, parallel to the street right-of-way and in front of which no building nor structure may be constructed.  (Ord. 1259 §2(part), 1999)

16.08.070 City.

“City” means the city of Goldendale.  (Ord. 1259 §2(part), 1999)

16.08.080 Commission.

“Commission” means the Goldendale planning commission.  (Ord. 1259 §2(part), 1999)

16.08.090 Comprehensive plan.

“Comprehensive plan” means those coordinated plans in preparation or which have been adopted by the city council for the physical development of the city.  (Ord. 1259 §2(part), 1999)

16.08.100 Council.

“Council” means the city council for Goldendale.  (Ord. 1259 §2(part), 1999)

16.08.110 Cul-de-sac.

“Cul-de-sac” means a short street having one end open to traffic and being terminated at the other end by a vehicular turn-around.  (Ord. 1259 §2(part), 1999)

16.08.120 Dedication.

“Dedication” is the deliberate appropriation of land by its owner for any general or public uses, reserving to himself no other rights than such as are compatible with the full exercise and enjoyment of the public use to which the property has been devoted.  (Ord. 1259 §2(part), 1999)

16.08.130 Easement.

“Easement” means a grant by a property owner to specific persons or to the public to use land for a specific purpose or purposes.  (Ord. 1259 §2(part), 1999)

16.08.140 Final plat.

“Final plat” is the final drawing of the subdivision and dedication prepared for filing for record with the county auditor and containing all elements and requirements set forth in this title and in all other applicable codes and ordinances.  (Ord. 1259 §2(part), 1999)

16.08.150 Lot.

“Lot” is a fractional part of divided lands having fixed boundaries, being of sufficient area and dimension to meet minimum zoning requirements for width and area.  The term shall include tracts or parcels.  (Ord. 1259 §2(part), 1999)

16.08.160 Lot, flag.

“Flag lot” means an interior lot in which the buildable area is not bounded laterally by a public or private road, and which gains road access by means of a lot extension, a driveway easement, or the terminus of a private or public road.  (Ord. 1259 §2(part), 1999)

16.08.170 Official plans.

“Official plans” means those maps, development plans, or portions thereof; adopted by the city council.  Such plans or maps shall be deemed to be conclusive with respect to the location and width of streets, public parks and playgrounds and drainage rights-of-way as may be shown thereon.  (Ord. 1259 §2(part), 1999)

16.08.180 Owner.

“Owner” is any individual, firm, association, syndicate, co-partnership or corporation having sufficient proprietary interest in the land sought to be subdivided to commence and maintain proceedings to develop land under this title.  (Ord. 1259 §2(part), 1999)

16.08.190 Pavement.

“Pavement” shall be asphaltic concrete for all principle, secondary, and residential streets, excluding large lot residential streets.  All large lot residential streets shall use at minimum bituminous surface treatment (BST) as specified by the city engineer.  (Ord. 1259 §2(part), 1999)

16.08.200 Performance bond or guarantee.

“Performance bond or guarantee” means that security which may be accepted in lieu of a requirement that certain improvements be made before the planning board or other approving body approves the final plat, including performance bonds, escrow agreements, and other similar collateral or surety agreement.  (Ord. 1259 §2(part), 1999)

16.08.210 Place or court.

“Place” or “court” means a public way, similar to a cul-de-sac, except that width of public access right-of-way shall be variable with the number of units to be served.  (Ord. 1259 §2(part), 1999)

16.08.220 Plat.

“Plat” is a map or representation of a subdivision, showing thereon the division of a tract or parcel of land into lots, blocks, streets and alleys or other divisions and dedications.  (Ord. 1259 §2(part), 1999)

16.08.230 Preliminary approval.

“Preliminary approval” is the official favorable action taken on a preliminary subdivision, metes-and-bounds description, or dedication following a duly advertised public hearing, which action may, or may not, impose conditional requirements necessary for final approval.  (Ord. 1259 §2(part), 1999)

16.08.240 Preliminary plat.

“Preliminary plat” is a neat and approximate drawing of a proposed subdivision showing the general layout of streets and alleys, lots, blocks, and other elements of a subdivision consistent with the requirements of this chapter.  The preliminary plat shall be the basis for the approval or disapproval of the general layout of a subdivision.  (Ord. 1259 §2(part), 1999)

16.08.250 Public hearing.

“Public hearing” means an official and open meeting held after:

A.    Notice is given by one publication in a newspaper of general circulation within the city at least ten days prior to the hearing;

B.    Written notice is mailed to all land owners within two hundred feet of the outside boundaries of the subject property at least ten days prior to the hearing; and

C.    The ten-day posting on the premises as required by statute have been provided.  (Ord. 1259 §2(part), 1999)

16.08.260 Roadway.

“Roadway” is that portion of a street intended for the accommodation of vehicular traffic, generally within curb lines.  (Ord. 1259 §2(part), 1999)

16.08.270 Shall.

“Shall” is mandatory and not directory.  (Ord. 1259 §2(part), 1999)

16.08.280 Street, private.

“Private street” means a street intended for the use of one or more private individuals and developed and maintained by those private individuals who benefit from its establishment which is not deeded to the city.  (Ord. 1259 §2(part), 1999)

16.08.290 Street, public.

“Public street” means a street held in public ownership, and intended for use by the general public as a means for vehicular travel.  (Ord. 1259 §2(part), 1999)

16.08.300 Subdivider.

“Subdivider” is any person, association, syndicate, copartnership, trust, firm, corporation or other ownership entity making, or having made, a subdivision.  (Ord. 1259 §2(part), 1999)

16.08.310 Subdivision.

“Subdivision” is the division or redivision of land into five or more lots, tracts, parcels, sites or divisions for the purpose of sale, lease, or transfer of ownership.  (Ord. 1259 §2(part), 1999)

16.08.320 Subdivision, short.

“Short subdivision” is the division or redivision of land into four or fewer lots, tracts, parcels, sites or divisions for the purpose of sale, lease, or transfer of ownership; provided, that the legislative authority of any city or town may by local ordinance increase the number of lots, tracts, or parcels to be regulated as short subdivisions to a maximum of nine.  (Ord. 1259 §2(part), 1999)

16.08.330 Tense inclusion.

Words used in the present tense include the future, singular include plural.  (Ord. 1259 §2(part), 1999)

16.08.340 Zoning ordinance.

“Zoning ordinance” means the zoning ordinance (Title 17) of the city.  (Ord. 1259 §2(part), 1999)

16.08.350 Other definitions.

Terms defined in GMC Title 17 shall have the meaning established under that title, unless otherwise defined above.  (Ord. 1259 §2(part), 1999)
