2.82.010 Department created.
There is created a police reserve unit to consist of such members as may be appointed from time to time by the chief of police. (Ord. 1191 § 1, 1987).
2.82.020 Duties and authority.
Members of the police reserve unit shall assist the police department in its duties as may be determined by the chief of police. No member of the police reserve unit shall have the authority to arrest for the commission of any crime other than the authority of a private citizen, unless otherwise commissioned by the chief of police, who is hereby empowered to commission any such members with the authority of a duly commissioned peace officer to make arrests upon a showing to the satisfaction of the chief of police by a reserve officer of his/her qualifications to be so commissioned, and upon his/her giving of the oath of a peace officer before a judge or magistrate. 2.82.030 Organization.
The police reserve unit shall be organized and administered by the mayor, the chief of police or by a reserve coordinator assigned by the chief of police to that function. Ranks of reserve police officers shall be designated, and appointments made thereto, as the chief of police deems necessary or advisable. (Ord. 1191 § 1, 1987).
2.82.040 Members.
A. Appointment. Members of the police reserve unit shall be appointed by the chief of police. No person shall be appointed as a member who:
1. Has ever been convicted of a felony or any crime involving moral turpitude;
2. Does not meet the requirements set forth in this chapter or in the bulletin announcing the examination;
3. Is physically or mentally unfit to perform the duties of the position which he seeks;
4. Is addicted to the use of intoxicating liquors or narcotics or habit-forming drugs;
5. Has been dismissed or has resigned in lieu of discharge from any position, public or private, for any cause which would be a cause for dismissal from city service, or whose record of employment has not been satisfactory in the city service or with any other employer;
6. Has abandoned any position in the city service or been absent from duty without leave of absence duly granted;
7. Has made any material false statement or has attempted any deception or fraud in connection with this or any other civil service examination;
8. Refuses to execute any oath as prescribed by law;
9. Fails to present himself for fingerprinting as required by the commission;
10. Has assisted in preparing, conducting or scoring the examination for which he applies or who has in any other manner secured confidential information concerning such examination which might give him an unfair advantage over other applicants in the examination;
11. Fails to present himself for or fails to pass the medical application prescribed by the commission;
12. Refuses to furnish all information required to complete the application;
13. Is knowingly a member of any organization which is included in the official list of subversive organizations, or is knowingly a member of any organization which to his knowledge now advocates the overthrow of the government of the United States or of this state by force or violence or other unlawful means, or now advocates the support of a foreign government against the United States in the event of hostilities;
14. Has been discharged from the armed forces under conditions other than honorable.
Members of the police reserve unit shall not be employees of the city and shall not be subject to nor have rights under the Grandview police civil service commission nor state statute concerning the discipline, tenure, and rights of police officers. A condition to appointment shall be certification by the Washington State Criminal Justice Training Commission.
B. Tenure. A member’s appointment to the police reserve unit may be revoked by the chief of police at any time it appears to him/her that such member is not satisfactorily performing his/her duties as a reserve police officer, or if such member otherwise conducts himself/herself in a manner so that the chief of police determines that such appointment should be revoked. The revocation of any member’s appointment shall also revoke that member’s commission to arrest as a peace officer. All members shall comply with the standards of the Washington Association of Sheriffs and Police Chiefs.
C. Status of Members. No reserve police officer shall be compensated for his/her duties as such, nor shall membership in the police reserve unit entitle any member to any relief or pension benefits under any plan administered under the police reserve unit; and promotions in rank shall be made solely at the discretion of the chief of police and shall not be subject to approval or review by the Civil Service Commission. 2.82.050 Rules and regulations.
A. Badge and Insignia. The city shall furnish a uniform, shield, insignia of rank and shoulder patch, all of distinctive and uniform design, to reserve police officers. All such badges, insignia and other city-owned property issued an officer shall be surrendered to the chief of police on termination of membership of that officer.
B. Identification Card. The chief of police shall issue an identification card to each reserve police officer identifying that office as a member of the police reserve unit of the city, which card shall contain a facial photograph of the officer. Any officer whose membership in the police reserve unit is terminated shall immediately surrender his/her identification card to the chief of police.
C. Firearms. A reserve police officer, while on duty in uniform, may carry a firearm at the discretion of the chief of police only after such reserve officer has qualified in a firearms training course under the direction of the chief of police, which consists of: successful completion of the basic reserve academy, Grandview police department qualification course, and at the discretion of the chief of police.
D. Administering Rules and Regulations. The chief of police may adopt such rules and regulations consistent with the provisions of this section as he/she deems necessary or convenient to organize and administer a police reserve unit and its functions. Specifically, the chief shall adopt a “Reserve Police Manual for the City of Grandview.” (Ord. 1191 § 1, 1987).
2.82.060 Workman’s compensation insurance.
The city shall provide and pay for workman’s compensation insurance to all members of the police reserve unit. (Ord. 1191 § 1, 1987).
2.82.070 Volunteer firefighters’ relief and pension benefits allowed for police reserve officers.
The state has by Chapter 41.24 RCW provided for the Volunteer Firefighters’ Relief and Pension Act the benefits of which are extended to qualifying reserve police officers.
The State Board for Volunteer Firefighters administers the Volunteer Firefighters’ Relief and Pension Act. (Ord. 1445 § 1, 1996).
2.82.080 Participation in volunteer firefighters’ relief and pension plan.
The city of Grandview shall allow participation in the volunteer firefighters’ relief and pension plan, administered by the State Board for Volunteer Firefighters, by qualifying reserve police officers under Option 3, which reads as follows:
3) To count and pay the cost of all credit for service as a reserve officer and to pay pension fees at the option of the member, who must agree to pay his/her portion of the fees plus interest, at an actuarial rate to be determined by the state board. Any portion of back fees may be assigned by the municipality to be paid by the member.
