5.08.010 Permit required.
It is unlawful for any person, firm, corporation, club, society or association to give or have part in giving any dance without first obtaining a permit from the city clerk in the manner provided by this chapter; provided, however, that any person may give or have a private dance in his bona fide residence without first obtaining such permit. (Ord. 2008-27 § 2).
5.08.020 Exemptions.
Any lodge, fraternal organization or society duly incorporated as such and having an established chapter in the city, or the Grandview Senior Center may give or have a private dance in the building occupied by it on its regular meeting nights and where such dance or dancing is incidental to the meeting only, and not its principal object; provided, that the dance is restricted to members of the organization and immediate family, and no fees, tickets or other admission charge or assessment is made upon those attending, or expense incurred for the same. 5.08.030 Application – Fee – Investigation of applicant – Issuance or refusal – Review – Security.
A. Any person wishing to give or have a dance shall make application to the city clerk, who shall, upon the payment of $50.00 for each day the dance shall be held, or $50.00 for an annual permit for retail food establishments or establishments having a Washington State Liquor Control Board license, refer the application to the police chief who shall cause the application, the applicant, and the building wherein the dance is to be held to be investigated. After such investigation the police chief shall either approve the permit, or refuse the same, with a copy of his refusal to be submitted to the city clerk’s office, and one copy of such refusal shall be forwarded by the city clerk to the applicant, together with a refund of fees paid. Any party aggrieved by the denial of a dance permit may appeal such denial under the provisions of Chapter 2.50 GMC.
B. The police chief or his designee shall determine in each case where a permit is granted whether persons are necessary to provide security at the dance. If the police chief determines that security is required based upon the nature of the dance, the number of individuals involved, and the presence or absence of alcohol service at the dance and any other relevant factors, said permit shall so provide. If security is required, the dance permit applicant may hire a private, licensed, bonded security service to provide security or may contract with the city to provide city police officers at rates to be set by the city which rates shall be sufficient to cover the costs of the city for payroll including overtime, if applicable, and all benefits and payroll taxes that must be paid by the city on behalf of the officers. 5.08.040 Prohibited persons and conduct.
It is unlawful for any person, firm, corporation, club or association maintaining, conducting or carrying on any dance, or having charge or control thereof, or any person employed in or about the same to allow or permit any person under the influence of intoxicating liquor, or any boisterous or disorderly person to enter, be or remain, or dance at such dance or in said dancehall to engage in any undue familiarity, or lewd, immoral or suggestive conduct; and it shall be the duty of the person maintaining, conducting or having charge or control of such hall to eject any person or persons engaged in such prohibited conduct. 5.08.050 Closing hours.
No dance shall be conducted later than 2:00 a.m. nor between the hours of 2:00 a.m. and 8:00 a.m.; provided, that on Sunday, the first day of the week, no dance shall be conducted between 2:00 a.m. and 12:00 noon. (Ord. 2008-27 § 2).
5.08.060 Lighting of room.
There shall be no turning out of lights or any use of dimmers whereby the room in which any public dance is held is so darkened that persons are indistinguishable from any part of the room. (Ord. 2008-27 § 2).
5.08.070 Police to have free access to premises.
All police officers of the city and of the county shall at all times have free access to all places in the city where any dance is being conducted, other than a private dwelling, for the purpose of preserving order and enforcing the provisions of this chapter or any other ordinance of the city and the laws of the state. (Ord. 2008-27 § 2).
5.08.080 Violation – Penalties.
Any person who violates any of the provisions of this chapter shall be subject to the penalties provided in GMC 5.04.140. (Ord. 2008-27 § 2).
