PARADES, MARCHES AND DEMONSTRATIONS

9.48.010 Permit – Required – Exception.

Any person, group of persons, organization, corporation or joint venture desiring to march, parade or demonstrate in or upon the streets, sidewalks or public places of the city shall, if such march, parade, or demonstration is to take place at any time or under circumstances likely to cause traffic congestion or other public inconveniences, at least five days prior to the march, parade or demonstration, apply to the city clerk of the city, or to her/his deputy, at the City Hall, for a permit for said purpose; provided, functions sponsored by the schools of the city may be held upon notice to the police department only. 9.48.020 Permit – Approval or denial.

Said permit shall be approved by the chief of police unless such parade, march or demonstration is likely to cause traffic congestion or other public inconvenience at the place or time requested by the permit applicant. (Ord. 2007-18 § 2).

9.48.030 Bond required.

The applicant shall provide for and be responsible to the city for any traffic control devices, and personnel required, and for cleaning up the area where the parade, march or demonstration takes place. A reasonable deposit, or indemnity bond in favor of the city in lieu thereof, on forms approved by the chief of police, in sufficient amount to cover the costs of traffic control and cleaning of the areas affected, shall be deposited with the chief of police to cover said costs. 9.48.040 Appeal – Hearing.

Any applicant feeling aggrieved by the ruling of administrative personnel of the city hereunder shall have the right to appeal said ruling to the city’s hearing examiner pursuant to Chapter 2.50 GMC by giving notice to the city clerk of intent to appeal. (Ord. 2007-18 § 2).

9.48.050 Violation – Penalty.

Any participant in a parade, demonstration or march held without complying with this chapter is guilty of a misdemeanor and, in addition to any fine or jail time, such person shall be assessed for all damages incurred. (Ord. 2007-18 § 2).
