OBSTRUCTING SIDEWALKS

9.64.010 Riding or driving on sidewalk – Penalty.

A. No person shall ride, drive or lead any animal, or ride any bicycle, or ride or move any vehicle upon any sidewalk in the downtown business district as provided in GMC 10.32.100(N), except light carriages for the conveyance of children or wheelchairs, unless for the purpose of crossing the sidewalk at a street or alley intersection, nor allow any vehicle, except persons in wheelchairs, or animals belonging to said person or in his care to stand on any sidewalk (except in approved bicycle racks) or do any other act which obstructs the passage of pedestrians, or endangers the public health, or injures the sidewalk.

Bicycle racks may be located upon public sidewalks only upon the application to and authority of the city council.

No bicycle rack may be placed as to obstruct pedestrian traffic. Owners of bicycle racks shall be responsible to see that bicycles are properly placed in racks and are responsible for the proper and safe maintenance of the bicycle rack. The city, prior to issuing a bicycle rack permit, may require that the owner of such a rack enter into an agreement to indemnify and hold the city harmless from any and all claims against the city due to the placement, maintenance, use or nonuse of said bicycle racks.

B. A violation of this section shall be a civil infraction punishable by a fine of not less than $50.00 nor more than $100.00. (Ord. 2007-18 § 2).

9.64.020 Displaying merchandise on sidewalk at night – Penalty.

A. No person shall permit, maintain, or cause to be kept, in an exposed condition upon or contiguous to any public sidewalk within the city between the hours of 6:00 p.m. and 7:00 a.m., any goods, wares or merchandise for sale to the public.

B. Violation of this section is a civil infraction punishable by a fine of not less than $25.00 nor more than $100.00. Each day said violation continues shall be considered a separate violation. (Ord. 2007-18 § 2).
