10.34.010 Skateboards and scooters prohibited.
No person shall ride a skateboard or scooter upon any street, sidewalk or public parking lot within the following described area of downtown Grandview:
An area bounded on the east by the easterly edge of the sidewalk on the east side of Birch Avenue; on the north by the northerly edge of the sidewalk on the north side of East Main Street (Wine Country Road); on the west by the westerly edge of the sidewalk on the west side of Grandridge Road; and on the south by the southerly edge of the sidewalk on the south side of Second Street. Also, both sides of Division Street from Second Street to Fourth Street. (Ord. 2007-10 § 2).
10.34.020 Definition of riding.
For purposes of this chapter, a person is deemed to be riding a skateboard or scooter if he/she is standing with one or both feet touching the skateboard or scooter or standing, crouching, sitting or lying upon the skateboard or scooter while it is in motion. (Ord. 2007-10 § 2).
10.34.030 Negligent operation of skateboards or scooter prohibited.
It is unlawful for any person to operate a skateboard or scooter in a negligent manner upon any roadway, sidewalks or publicly owned parking lot whether or not said operation occurs within the area described in this chapter. For purposes of this section, “to operate in a negligent manner” means the operation of a skateboard or scooter in such a manner as to endanger or be likely to endanger any person or property. 10.34.040 Violation – Penalty.
A. Any person violating any provision of this chapter shall be guilty of a civil infraction and, upon a finding of a violation thereof, shall be subject to a monetary penalty of not more than $300.00.
B. In addition to said penalty, any skateboard or scooter used in violation of this chapter may be impounded by the Grandview police department.
C. Any willful failure to respond to a notice of infraction under this chapter shall be a misdemeanor. (Ord. 2007-10 § 2).
