STREET AND SIDEWALK OBSTRUCTIONS

12.12.010 Obstructions prohibited.
It is unlawful for any person, firm or corporation, to place or cause to be placed, any obstacle, barrier or obstruction of any kind whatever, in, on, along or upon any business or arterial street, sidewalk, public road or highway within the corporate limits of the city of Ilwaco, Washington; provided, however, that this chapter shall not apply strictly to residential streets and connecting cross streets where public use, enjoyment and passage is incidental, and not general. 12.12.020 Permits required.
In cases of emergency and unavoidable necessity, obstructions, obstacles or barriers may be placed in, on, along or upon any business or arterial street, sidewalk, public road or highway, within the corporate limits of the city of Ilwaco, Washington, upon a proper showing of emergency or unavoidable necessity, by procuring a written permit so to do from the chairperson of the committee on streets of the council of the city; which permit shall expire at the meeting of the council following the granting of the same; and the same must be renewed before the council by a written application which must clearly show the emergency therefor. 12.12.030 Removal of obstructions.
It is the duty of the chief of police of the city of Ilwaco, Washington, to remove or cause to be removed, without notice or previous warning to the owner thereof, any obstacle, obstruction or barrier, in, on, along or upon any business or arterial street, sidewalk, public road or highway within the corporate limits of the city, at the proper cost and expense of the owner thereof. 12.12.040 Operation of bicycles, unicycles and skateboards on public sidewalks.
A. It is unlawful to operate a bicycle, unicycle and/or skateboard upon public sidewalks within the city limits of the city of Ilwaco.
B. Bicycles and unicycles shall be parked in racks if available.
C. No person shall park a bicycle or unicycle in such manner as to obstruct sidewalks or private accesses.
D. It is unlawful to leave a skateboard unattended at any time on a public sidewalk.
E. A bicycle left unattended on a public sidewalk for more than twenty-four (24) hours may be impounded by the police department.
F. Violation — Penalty. Any person violating any provision of this ordinance shall be guilty of a civil infraction and upon conviction thereof shall be punished by the imposition of a monetary penalty of not more than fifty dollars. Community service hours may be imposed in addition to or in lieu of the monetary penalty. (Ord. 642 §§ 1, 2, 2000)
