2.10.010 Established.

Pursuant to the authority of the Kelso City Charter, (KCC herein) Section 4.01(a), there is established for the city the office of city clerk. Pursuant to KCC Section 4.05, the office shall be filled by appointment by the city manager subject to KCC Section 4.02, as limited by KCC Section 9.01. (Ord. 3273 § 1, 1995)

2.10.020 Duties.

The duties of the city clerk shall include, but not be limited to, the following:

A. Give notice of all council meetings to councilmembers, the media and the public when such is required by law;

B. Keep and preserve a journal of all council proceedings;

C. Read by title or otherwise, as required by law, all proposed ordinances and resolutions and maintain copies of the same available for inspection by the public after the first reading;

D. Authenticate by signing and maintaining, properly indexed all adopted ordinances and resolutions of the city, including any codes of technical regulations which are adopted by reference. Copies of such ordinances and codes shall be made available to the public by purchase at a reasonable price;

E. Act as the official custodian of any and all records of the city and be responsible for the certification or authentication of such records when appropriate;

F. Insure that public records are available for inspection and copying during regular business hours and that they are protected from abuse and destruction. This duty shall include the providing of forms for and responding to any lawful request for production of such records under Chapter 2.26;

G. Retain and maintain all signed originals of contracts and transactions to which the city may be a party, and the signed originals of all deeds and instruments of conveyance regarding real and/or personal property transactions wherein the city is grantee or transferee;

H. Make copies of any such records available to department heads or those they designate when necessary or convenient in the performance of their duties;

I. Be the official custodian and keeper of the seal of the city;

J. Comply with General Records Retention Schedule for Cities and Towns promulgated by the Washington State Local Records Committee pursuant to its authority under the provisions of RCW 40.14.070 and WAC 414-24-00, as the same now exist or are hereafter amended; and

K. Perform any other duties or functions assigned to the office by charter, ordinance or general law. (Ord. 3273 § 2, 1995)

2.10.030 Performance of duties.

A. Any duties or functions assigned herein to the city clerk may be performed by the city manager, a deputy clerk or other agent where appropriate.

B. Pursuant to KCC Section 4.01(b), all duties and functions set forth herein shall be performed under the direction and supervision of the city manager. (Ord. 3273 §§ 3, 4, 1995)

2.10.040 City clerk and director of finance –Offices combined.

The city manager is authorized, pursuant to KCC Section 4.01(b), to appoint one person as city clerk and director of finance to serve as the head of both offices simultaneously. (Ord. 3273 § 5, 1995)

2.10.050 Use of terms.

Whenever in any ordinance heretofore or hereinafter enacted any of the following terms are used: “clerk,” “director of finance,” “finance director,” “treasurer, “clerk treasurer,” or any other term used in a context denoting a function normally assigned to the city clerk, such term shall be construed to mean city clerk. If any such terms are used in a context denoting a function normally assigned to the director of finance, they shall be construed to mean director of finance. It is the intent that all such terms have been and may be used interchangeably. (Ord. 3273 § 6, 1995)
