9.48.010 Rules and terms of conduct established.
The city manager or his designee is hereby authorized to establish rules and terms of conduct for all users of the transportation center known as Kelso Station. Said rules shall include, but not be limited to, any violations of the law on or near the Kelso Station premises, and shall prohibit disorderly and unruly conduct, the annoying of any person lawfully using the said premises and any other conduct detrimental to the operation of the transportation center. Said rules shall also provide for the exclusion of any person from the premises who violate any law of the city or rule promulgated hereunder. (Ord. 3623 § 1, 2006; Ord. 3347 § 1, 1997)
9.48.015 Unlawful conduct.
No person shall:
A. Loiter at the depot, or its immediate surrounding area, or the steps in front of the building, for any other purpose other than for the purpose of using transportation services provided at the Kelso Train Depot or for the purpose of conducting lawful business on premises under lease or other agreement with the city of Kelso.
B. Engage in continued use of the bathrooms for showering, shaving, bathing, or other grooming that is commonly conducted at one's home or a private facility according to common experience in the community.
C. Prima facie evidence of lawful use of the depot shall be:
1. Possession of a bona fide ticket to travel either by rail or bus for that day;
2. Confirmation with a tenant of the city of Kelso that his/her presence is for lawful business purposes of the tenant. (Ord. 3623 § 1, 2006)
9.48.020 Definitions.
A. “Bus terminal” as used herein shall include the use of a location for one or more of the following activities: the announcement of the departure or arrival of vehicles carrying passengers, the regular loading and unloading of passengers, baggage and/or express, the ticketing of passengers, providing telephone information or any similar activity.
B. “Person” as used herein shall be defined as defined in Section 1.04.010(9).
C. “Premises controlled by the city” shall mean any property owned or leased by the city and shall include all public rights-of-way such as streets, alleys, parking areas and similar locations within the city. (Ord. 3623 § 1, 2006; Ord. 3413 § 1, 1999; Ord. 3389 § 1, 1998)
9.48.030 Use of terminal without permit.
It shall be unlawful and an offense for any person to utilize the Kelso Station, or any other premises controlled by the city, as a bus terminal without having first procured a permit or an agreement with the city for that purpose. Each day of such unlawful use shall constitute a separate violation. Each violation shall be considered an infraction and shall carry a civil penalty of not less than five hundred dollars, a portion of which may be suspended by the court for first offenders.
