13.16.010 Federal Communications Commission rules followed.

The city declares that it will follow the rules of the Federal Communications Commission relating to the regulation of basic service rates and charges and relating to the regulation of customer protection and customer service as such rules apply to cable television systems operating in the city, notwithstanding any different or inconsistent provisions contained in Ordinances 2817 and 3091 of the city. The rules of the Federal Communications Commission are contained in Volume 47 of the Code of Federal Regulations (47 CFR) Part 76. (Ord. 3247 § 1, 1994)

13.16.020 Public meeting required.

In the course of regulating basic service rates and charges and provisions for customer protection and service, the city shall assure a reasonable opportunity for the receipt and consideration of the views of interested parties. To achieve such assurance, the city council shall exercise its power in the regulation of basic service rates and charges and provisions for customer protection and service only at a public meeting of said city council conducted after receipt by the city of FCC Form 393 from all franchisees operating cable television companies in the city. Before such public meeting the general public shall be permitted to submit written statements and letters to the city council relative to basic service rates and charges and about provisions for customer protection and service. Such written statements and letters shall be considered by the city council at the time that it exercises its regulatory power in accordance with this chapter. (Ord. 3247 § 2, 1994)

13.16.030 City manager to file forms.

The city manager, or his designee, is authorized to execute on behalf of the city and file with the FCC such certification forms or other instruments as are now or may hereafter be required by the FCC rate regulations in order to enable the city to regulate basic service rates and charges and provisions for customer protection and service of cable television.
