5.28.010 Purpose.

This chapter shall regulate licensing of businesses and certain business practices, namely holding dances and selling goods from door to door and providing the general penalty thereof for violations. (Ord. 286 § 1, 1978).

5.28.020 Definitions.

For the purposes of this chapter the following words shall have the meanings ascribed to them as follows:

(1) “Daily business license” means a license obtained to run from 12:01 a.m. to 12:00 midnight. Any portion thereof shall be considered as one day.

(2) “Itinerant salesmen, peddler, or vendor” means persons selling goods within the city on a single, occasional or irregular basis.

(3) “Party plan” means the practice wherein goods are sold or solicitation for their sale is had by inviting prospective customers into the home of the seller, or having them invited into other homes where the seller can make contact with them.

(4) “Person,” “firm,” “corporation” and/or “association” means any person, firm, corporation or association which engages in any business described in this chapter, or having control over any of the businesses or business practices described in this chapter; provided, however, that the payments of such fee by any person, firm, corporation or association enumerated in this chapter shall be deemed a compliance with this subsection. 5.28.030 License – Required for itinerant salesman, vendor or peddler.

The following persons, firms, corporations or associations shall obtain a daily business license: each itinerant salesman, vendor or peddler. (Ord. 286 § 3, 1978).

5.28.040 License – Required for dances.

Each person, firm, corporation or association wishing to hold a dance within the city for which admission shall be charged shall obtain a business license therefor on a per dance basis. This section does not apply specifically to functions of the Kittitas School District No. 403, at which dances may occur. (Ord. 286 § 4, 1978).

5.28.050 License – Application.

The licenses required by this chapter are separate from and in addition to the general business license issued under Chapter 5.04 KMC, which may also be required when applicable. Applications for the licenses enumerated in this chapter shall be made with the city clerk-treasurer, or his or her designated appointee, on the proper form provided by the clerk-treasurer. 5.28.060 License – Fees.

Every applicant before being granted a license shall pay the following license fees:

(1) Itinerant salesmen, vendors, peddlers, $10.00 per day;

(2) Dances (per dance), $10.00 per day. (Ord. 286 § 6, 1978).

5.28.070 License – Display.

Licenses issued under this chapter shall be displayed as follows:

(1) Daily itinerant salesmen, vendors, peddlers, on the person of the licensee;

(2) Dances, at the place where the dance is held. (Ord. 286 § 7, 1978).

5.28.080 Violation – Penalty.

Violations of this chapter shall be punished by a civil fine not to exceed $500.00. (Ord. 02-679 § 1; Ord. 286 § 8, 1978).
