18.180.010 Purpose and intent.

It is the purpose and intent of this chapter to set forth terms and conditions applicable to manufactured homes equivalent to those for all other dwellings, in order not to discriminate against the placement and use of manufactured homes in compliance with RCW 35.63.160 and 35A.21.312. This chapter shall not override any legally recorded covenant or deed restrictions of record. [Ord. 2023-11 § 9 (Exh. G), 2023; Ord. 2006-17 § 1, 2006.]

18.180.070 Installation standards.

(1) Manufactured homes shall meet all of the following criteria:

(a) Must be new as defined by RCW 35.63.160 now or hereafter amended;

(b) Be built to meet or exceed the standards established by federal law in 42 U.S.C. Sections 5401 through 5403, now or hereafter amended;

(c) Must be designated as defined by RCW 35.63.160;

(d) Be set upon a permanent foundation, as specified by the manufacturer, and that the space from the bottom of the home to the ground be enclosed by concrete or an approved concrete product which can be either load bearing or decorative;

(e) Shall comply with all other siting, density, design, and dimensional standards of the zoning district in which they are located; and

(f) Be thermally equivalent to the state energy code.

(2) The requirements of the city public works director and police chief for moving a manufactured home to a permanent location, with respect to traffic and safety, shall be met. These requirements shall include, but not be limited to:

(a) Route of travel with a traffic control plan;

(b) Time of move; and

(c) Posting of surety bond(s) in an amount adequate to ensure repair to public or private property which may be damaged by movement of the building. The amount of the bond shall be determined by the city public works director. [Ord. 2023-11 § 10 (Exh. G), 2023; Ord. 2006-17 § 1, 2006.]

18.180.080 Requirements of manufactured home subdivisions and communities.

A manufactured home subdivision or community shall meet the requirements of this section.

(1) Setbacks.

(a) Garages facing a public street shall be set back a minimum of five feet from the front property line.

(b) Porches, balconies, or similar entry appendages may project into the front yard setback up to three feet from the property line.

(2) Design Standards.

(a) Rooflines of new or replacement dwellings shall be a minimum of 3:12 for pitched roofs. Lower pitched roofs or parapet rooflines shall provide additional architectural detailing including but not limited to cornices, caps, relief panels, bay windows, shade projections, rain protection, eaves, dormers, ledges, or overhangs as approved by the planning director.

(b) Rain protection shall be located at the primary entrance which is effectively designed to provide a minimum of 25 square feet of rain protection. This protection may use a single or combination of techniques such as awning, eave, alcove, airlock, or recessed entry.

(c) Finished surfaces on new or replacement dwelling elevations shall emphasize use of architectural-grade natural building products such as wood, masonry, metal, glass, stucco, fiber cement, cultured stone, or other stone materials. Use of plywood, vinyl, plastic composites, fiberglass or similar products shall reflect the surface character of natural building products.

(d) New or replacement structures shall employ a diverse use of color to display individuality within the community. Finished surfaces suitable for painting shall incorporate a color palette of at least two colors, consisting of a base color and an accent (trim color). Repetitive or predictable alternate color schemes are discouraged.

(3) All manufactured home subdivisions or communities shall provide for a homeowners’ association (HOA), which shall:

(a) Provide for the ownership and perpetual maintenance of all common areas, including but not limited to:

(i) Stormwater facilities;

(ii) Public streets, private roads, alleyways, trails, and other public or private accessways;

(iii) Common open space, parks and recreation areas, trails, and/or indoor common areas; and

(iv) Signs, monuments, and other forms of common identification.

(b) Promulgate, maintain, and enforce covenants, conditions, and restrictions (CC&Rs) particular to that subdivision or community.

(c) Provide the city clerk’s office with notice of HOA activities on an ongoing basis.

(4) All manufactured home subdivisions or communities shall provide pedestrian and/or trail linkages across the subdivision or community consistent with the city’s adopted parks and recreation plan or its successor and shall provide pedestrian and trail links consistent with city standards from the subdivision or community to off-site public parks or trails.

(5) The city shall review proposals for manufactured home subdivisions or communities through a Type III public review process. [Ord. 2023-11 § 11 (Exh. G), 2023.]

18.180.090 Additional requirements of manufactured home communities.

(1) In accordance with RCW 35A.21.312, the city cannot:

(a) Restrict the location of manufactured homes in manufactured home communities that were legally in existence before June 12, 2008, based exclusively on the age or dimensions of the manufactured home;

(b) Prohibit the siting of a manufactured home on an existing lot based solely on its lack of compliance with existing separation and setback requirements; or

(c) Prevent the entry or require the removal of a recreational vehicle used as a primary residence in a manufactured home community. However, a recreational vehicle sited in a manufactured home community will require:

(i) Compliance with fire, safety, and other regulations related to recreational vehicles;

(ii) Utility hookups to meet state or federal building code standards for manufactured home communities or recreational vehicle parks; and

(iii) One internal toilet and at least one internal shower, or toilets and showers must be provided in the manufactured home community. [Ord. 2023-11 § 12 (Exh. G), 2023.]
