9.40.010 Domestic case surcharge.

An additional fee is hereby imposed upon the initial filing of all Lewis County superior court cases filed under RCW Title 26, which fee amount shall be set by resolution and which fee shall be collected by the Lewis County clerk and remitted to the Lewis County treasurer and shall be maintained in a separate account as provided by RCW 26.12.240. [Ord. 1356, 2024]

9.40.020 Marriage license surcharge.

A fee of $23.00 is hereby imposed in addition to the fees set by RCW 36.18.010 upon the issuance of marriage license by the Lewis County auditor, which fee shall be collected by the Lewis County auditor and remitted to the Lewis County treasurer and shall be maintained in the court facilitator account. 9.40.030 Authority to impose fee for use of court facilitator.

A fee is hereby authorized for the reservation of the time of the courthouse facilitator in an amount not to exceed $25.00 per visit. Such fee may be payable at the time the reservation is made. Fees collected under this section shall be promptly remitted to the county treasurer and maintained in the court facilitator account for the uses set forth for that account. [Ord. 1356, 2024]

9.40.040 Use of funds in court facilitator account.

The monies in the court facilitator account may be spent only after appropriation. Expenditures from the account may be used only for the personnel, benefits, and maintenance and operations incident to the court facilitator program of the superior court to provide services and materials to assist persons who are not represented by counsel in civil cases brought pursuant to RCW Title 26. 9.40.050 Severability.

Should any section, paragraph, sentence, clause, or phrase of this chapter, or its application to any person or circumstance, be declared unconstitutional or otherwise invalid for any reason, or should any portion of this chapter be preempted by state or federal law or regulation, such decision or preemption shall not affect the validity of the remaining portions of this chapter or its application to other persons or circumstances. 9.40.060 Effective date.

The effective date of the ordinance codified in this chapter shall be January 1, 2024. [Ord. 1356, 2024]
