15.102.010 Specifications for improvement.
All specifications for extensions, expansions, additions, betterments, and replacements to the existing stormwater utility system shall be determined by the director subject to the following limitations: No stormwater main or culvert less than 12 inches in diameter shall be installed without specific prior approval of the director.
Stormwater infrastructure shall be constructed in accordance with the Longview Engineering Special Provisions and Standard Drawings and the SWMMWW. (Ord. 3540 § 1, 2024; Ord. 3533 § 1, 2024).
15.102.020 Burden of replacement costs.
Whenever any stormwater infrastructure for the utility service, now or hereafter installed, require replacement due to obsolescence, inadequacy, or deterioration, the cost of such replacement shall be paid for out of the revenues of the stormwater utility. (Ord. 3533 § 1, 2024).
15.102.030 System extensions and additions.
All extensions or additions of infrastructure required to serve new consumers shall be constructed at the expense of the consumers or the property benefited. In all cases the size of the pipes will be approved by the director. Such extensions and additions shall be installed, and the cost thereof provided for by the property owner, in any manner satisfactory to the department as permitted by law.
(1) All stormwater projects will be subject to Chapter 17.80 LMC and review of the minimum technical requirements of the current SWMMWW.
(2) Fill and grade permits will be subject to Chapter 17.80 LMC and review of the minimum technical requirements of the current SWMMWW.
(3) Fees for stormwater application review and for excavation and grading permits will be set periodically through resolution of city council. (Ord. 3540 § 1, 2024; Ord. 3533 § 1, 2024).
15.102.040 Application.
Any person desiring to extend or add to the stormwater system shall make application through the city’s public improvement process (PIP) as provided in Chapter 12.10 LMC or the local improvement district (LID) process as provided in Chapter 14.08 LMC. (Ord. 3540 § 1, 2024; Ord. 3533 § 1, 2024).
15.102.050 Easements.
(1) A public stormwater easement is required to be granted to the city when a public stormwater facility will be built on private property.
(2) A private stormwater easement is required to be granted between property owners whenever:
(a) A private stormwater facility will be built on property owned by a different private party; or
(b) A stormwater pipe will serve two or more properties;
(c) Private stormwater from one property owner will flow across property owned by a different party. (Ord. 3540 § 1, 2024; Ord. 3533 § 1, 2024).
15.102.060 Record drawings.
All applicants or permittees shall file a record drawing showing the location and configuration of the private stormwater connections to the public system and all private stormwater conveyances and facilities. (Ord. 3540 § 1, 2024; Ord. 3533 § 1, 2024).
15.102.070 Inspections and investigations.
(1) All work on public or private stormwater systems shall be subject to inspection by the city to ensure compliance with applicable state and local laws and conformance with the requirements and standards set forth in the permit conditions, if any.
(2) An authorized representative of the city may enter private property at all reasonable times to conduct inspections, tests or carry out other duties imposed by this chapter consistent with the terms and conditions of any covenant, easement, or other legal document applicable to the property.
(3) The city may require inspection tees or manholes in the stormwater connections to the public stormwater system at its discretion to facilitate inspections and/or investigations.
(4) For inspection programs authorized by the director, the city may provide advance mailings of its intent to inspect properties consistent with such inspection, testing, or other utility programs. (Ord. 3540 § 1, 2024; Ord. 3533 § 1, 2024).
