16.10.010 Submittal requirements.

A boundary line adjustment shall be prepared in the following manner and shall be submitted with the following minimum information in order to be considered for a complete application:

A. A land surveyor registered in the state of Washington shall prepare or supervise the preparation of the boundary line adjustment.

B. A registered land surveyor shall survey the land to be divided, and as much of the sections in which the land is located as is needed to properly orient the land within the sections. The survey shall be prepared in accordance with applicable state standards.

C. A legal description of the existing property boundaries and a legal description describing the new property boundaries should the boundary line adjustment be prepared.

D. A calculation of lot areas before and after the boundary line adjustment if approved.

E. A boundary line adjustment site plan shall be drawn to scale of one inch equals 50 feet or to a scale as approved in advance by the city engineer and director of community development. The city engineer shall review the initial submittal and determine if additional information is required on the drawing or otherwise as may be necessary to evaluate the proposed boundary line adjustment.

F. A certificate of title dated within the last 30 days, together with copies of all recorded documents affecting the property.

G. A concise narrative explaining the boundary line adjustment.

H. A completed application form provided by the city and signed by all of the owners and holders of financial interest in the affected properties. (Ord. 2005-609 § 2)

16.10.020 Review criteria.

Boundary line adjustments shall be processed in accordance with MCMC Title 14. Boundary line adjustments shall be reviewed and shall be approved in writing by the city engineer and director of community development only after they determine the boundary line adjustment meets all of the following criteria:

A. The application bears the signatures of the owners and holders of financial interests of the affected properties and is accompanied with a title certificate prepared within 30 days preceding the date of application.

B. The boundary line adjustment will not affect more than four lots and will not create more lots than existed before the application.

C. The boundary line adjustment will not create lots or other conditions which do not meet the requirements of the zone district and other applicable development regulations.

D. The boundary line adjustment will not violate or impair the covenants or conditions of any final plat or short subdivision, conditions of preliminary plat or short subdivision approval, or other development approvals affecting the property.

E. The application is accompanied by approvals from other agencies with jurisdiction as required. (Ord. 2005-609 § 2)

16.10.030 Filing required.

Approved boundary line adjustments shall be filed by the applicant with the Snohomish County auditor within 30 days of approval. A copy of the boundary line adjustment documents stamped with a recording number shall be delivered to the city within 14 days of recording. The city shall not process any permits related to an approved boundary line adjustment until these requirements are satisfied. (Ord. 2013-762 § 8; Ord. 2005-609 § 2)
