INTRODUCTION

17.01.010 Purpose.
The purpose of this title includes but is not limited to promoting the health, safety and general welfare by guiding the development of the city consistent with the policies and maps of the comprehensive plan and amendments thereto, which are, in part, carried out by the provisions of this title. This title is further intended to provide regulations and standards that will:
A. Encourage high standards of development;
B. Facilitate variety in housing type and commercial land use base;
C. Provide adequate water, light and air;
D. Avoid excessive concentration of population by establishing and implementing appropriate development and design standards;
E. Lessen congestion on the streets;
F. Facilitate adequate provisions for transportation, utilities, schools, parks, essential public facilities, pedestrian circulation, open space and other necessary public needs;
G. Prevent the creation or maintenance of public nuisances;
H. Ensure a healthful environment;
I. Require, when feasible, the use of LID techniques;
J. Establish cutting preserves and roadway buffers consistent with the streetscape element of the comprehensive plan;
K. Support private and public efforts to obtain conservation easements in areas with significant vegetation backdrops, scenic vistas, environmental attributes, and/or wildlife habitat; and
L. Encourage the use of recycled or recyclable construction products. (Ord. 2017-814 § 2; Ord. 2005-609 § 2)
17.01.020 Scope.
A. The provisions of this title shall apply to all uses of land in the city of Mill Creek; provided, however, that any rezone with a concomitant agreement approved by the county or approved by the city council prior to the effective date of the ordinance codified in this title shall be developed in accordance with the terms and conditions of the concomitant agreement until the property is rezoned subsequent to the adoption of this title.
B. The provisions of this title shall be interpreted as the minimum requirements necessary to protect the health, safety and general welfare of the public.
C. All uses at the specified location shall comply with the Mill Creek comprehensive plan, subarea plans, and all applicable federal, state, regional and city laws, plans and regulations.
D. Where the provisions of this title impose restrictions on the use of land, or structures greater than are imposed by other public or private regulations, the provisions of this title shall control. (Ord. 2005-609 § 2)
