2.08.002 Clerk-controller--Office created--Appointment procedure.

(a)    The office of the treasurer of the city shall be combined with that of the clerk of the city, and given the title of city clerk-controller. The clerk-controller shall be appointed by the mayor; provided, that the appointment shall be subject to confirmation of a majority vote of the city council, said vote to be taken at a regularly scheduled meeting of the city council. This appointment shall be in writing, signed by the mayor, and filed with the office of the city clerk-controller.

(b)    In the event the mayor determines that it is necessary to remove or terminate the individual designated as clerk-controller, then the mayor shall give notice to the individual and to the council of such desire, stating the reasons therefor. The removal or termination shall not become effective until the decision of the mayor is confirmed by a majority vote of the city council taken in the same manner as provided for appointment. The term of the civil servant/employee shall be from the date of appointment and confirmation until the date of resignation, retirement or voluntary separation from service or the concurrent action of the mayor and council above referenced, whichever shall first occur. 2.08.004 Clerk-controller--Powers and duties.

The clerk-controller, in addition to all of the duties and powers set out in RCW 35.24.120, shall exercise all the powers and duties vested in and performed and required to be performed by the treasurer, as set out in RCW 35.24.130, and in cases where the law requires the treasurer to sign or execute any papers or documents, it shall not be necessary for the clerk-controller to sign as treasurer, but shall be sufficient if the individual holding that post signs as clerk-controller. The clerk-controller shall further have the duties and responsibilities imposed by RCW 35A.21.030, RCW 35A.42.010 and RCW 35A.42.040. The clerk-controller shall exercise any and all other powers and perform any and all other duties vested or required by law, ordinance or regulation. (Ord. 987 §2, 1975).

2.08.006 Clerk-controller--Qualifications.

The clerk-controller shall have such qualifications as the mayor determines to be sufficient to competently carry out the duties imposed upon the office of city clerk-controller. (Ord. 987 §5, 1975).

2.08.008 Clerk-controller--Bond required.

Subsequent to the confirmation of appointment by the city council and prior to the entry into the duties of the office of clerk-controller, the individual appointed shall furnish an official bond in an amount established by ordinance conditioned on the honest and faithful performance of the clerk-controller's official duties. The premium on such bond shall be paid by the city. (Ord. 987 §3, 1975).

2.08.010 Clerk-controller--Auditing officer duties required.

The clerk-controller shall be the auditing officer or the city and shall perform those duties specified in RCW 42.24 for such officer. (Ord. 987 §6, 1975).

2.08.012 Clerk-controller--Compensation.

The compensation for the office of clerk-controller shall be set by ordinance. (Ord. 987 §4, 1975).

2.08.014 Clerk-controller--Addition and deletion of accounts.

With the goals of assuring that the budgetary documents of the city properly reflect its state of fiscal affairs and thus to correctly reflect revenues and expenditures, subject to prior approval of the council, the clerk-controller shall be authorized:

(1)    To establish such additional sub-accounts within those funds and accounts which may be from time to time set forth within the budget for the city as may be required and authorized within the BARS accounting system issued by the Office of the State Auditor; and

(2)    To dissolve such subsidiary funds or sub-accounts as may no longer be necessary and appropriate for the operation of the city and transfer any moneys which may be present within such dissolved accounts or funds to the appropriate fund or account. (Ord. 1540 §1, 2010).

2.08.020 Director of public works appointment, duties.

(a)    There is established the position of director of public works, whose duty shall be the care and maintenance of city streets, alleys, sidewalks and other public thoroughfares, and any other work that may be required of him by the mayor and/or city council.

(b)    The director of public works, who shall be deemed also to serve as superintendent of public works, shall be appointed by the mayor, with the approval of the city council. In the event the mayor determines that it is necessary to remove or terminate the individual designated as director of public works, then the mayor shall give notice to the individual and to the council of such desire, stating the reasons therefor. The removal or termination shall not become effective until the decision of the mayor is confirmed by a majority vote of the city council taken in the same manner as provided for appointment. The term of the civil servant/employee shall be from the date of appointment and confirmation until the date of resignation, retirement or voluntary separation from service, or the concurrent action of the mayor and council above referenced, whichever first occurs. 2.08.030 Building inspector appointment, duties.

There is established the position of building inspector, whose duty shall be the approval of building permit applications and land use permit applications, and who shall make periodic inspections of buildings under construction, and any other work that may be required of him by the mayor and/or the city council.

The building inspector shall be appointed by the mayor with the approval of the city council. (Ord. 839 §§1, 2, 1963).

2.08.040 Sewer and water treatment operator.

There is established the position of sewage and water treatment operator, whose duties shall be the care and maintenance of the sewage treatment plant, the water treatment plant, the water headworks system and the water reservoir. He shall flush and repair fire hydrants, and do any other work that may be required of him by the mayor and/or city council.

The plant operator shall be appointed by the mayor with the approval of the city council. (Ord. 838 §§1, 2, 1963).

2.08.050 City attorney appointment, duties.

The city attorney shall have such duties, responsibilities, and authority as may be from time to time established by law, ordinance, or direction of the mayor or council. These duties shall include, but not be limited to the following: to draw up all ordinances in proper form for passage by the city council; draw up all contracts and other papers of every kind and description necessary in the transaction of the city's business to the extent that they require legal advice and guidance in their drafting; to advise the council, mayor, and other officers of the city on all questions pertinent to the interests of the city; and to transact and perform all the legal business of the city of every kind and nature whatsoever.

The office of city attorney is hereby made appointive, and said office shall be filled by the mayor, subject to confirmation by a majority vote of the city council. In the event the mayor determines it is necessary to remove or terminate the individual designated as city attorney, then the mayor shall give notice to the individual and to the council of such desire, stating the reasons therefor. The removal or termination shall not become effective until the decision of the mayor is confirmed by a majority vote of the city council taken in the same manner as provided for appointment. The term of the city attorney shall be from the date of appointment and confirmation until the date of resignation, retirement or voluntary separation from service, or the concurrent action of the mayor and council above referenced, whichever shall first occur. 2.08.060 City forester appointment, duties.

(a)    There is established a position of city forester whose duty shall be the care and maintenance of the forests and woodlands which from time to time may be within the ownership or control of the city and any other work or responsibilities that may be from time to time required of the city forester by the mayor or city council.

(b)    The city forester shall be appointed by the mayor with the approval of the city council. In the event the mayor determines that it is necessary to remove or terminate the individual designated as city forester, then the mayor shall give notice to the individual and to the council of such desire, stating the reasons therefor. The removal or termination shall not become effective until the decision of the mayor is confirmed by a majority vote of the city council taken in the same manner as provided for appointment. The term of the civil servant/employee shall be from the date of appointment and confirmation until the date of resignation, retirement or voluntary separation from service or the concurrent action of the mayor and council above referenced, whichever first occurs. (Ord. 1193 §3, 1983).

2.08.070 City administrator/chief financial officer appointment, duties.

(a)    There is created the position of city administrator/chief financial officer. Any individual serving in this position shall be appointed by the mayor. The appointment shall be subject to confirmation by a majority vote of the city council. Compensation payable to the person holding the position of city administrator/chief financial officer shall be as established in each annual budget. In the discretion of the mayor and council, further terms and conditions of employment may be set out in a written contract of employment. Any such contract must be approved by the council and executed by the individual in order to be binding upon the city. In the absence of any such contract, the employment shall be at will.

Following confirmation of an individual to the position, involuntary removal of a person serving as city administrator/chief financial officer shall require the concurrence of the mayor and a majority vote of the city council.

(b)    Consistent with the mayor's authority as set forth in RCW 35A.12.100, subject to the mayor's direction, any individual hired under the position title "city administrator" shall coordinate all departments and directly supervise the heads of the departments of the city and others as required; provided, that this delegation shall not reduce the authority of the mayor as granted by the provisions of law. Further, the city administrator shall perform such other duties as may be determined from time to time by the mayor and/or city council.

Any individual hired under the position title "chief financial officer," with the approval of the mayor, will only have supervisory authority over heads of the departments of the city in relation to financial matters. General supervisory authority will remain with the mayor. Further, the chief financial officer shall perform such other duties as may be determined from time to time by the mayor and/or city council.

(c)    In recognition of the historical pattern of operation and the requirements of RCW 35A.12.040, unless another individual is appointed and confirmed to fill the position of clerk-controller, the individual serving as the city administrator/chief financial officer shall have the duties and authority of the clerk-controller; provided, that in the event such a separate appointment is made, then the city administrator/chief financial officer shall be relieved from such direct responsibility for performance of those duties, but shall have supervisory authority over that individual.
