Emergency Reduction of Speed Limits

9.12.020 Penalty for violation.
9.12.010 Procedure.
The mayor of the city of Montesano, or in the absence of the mayor, the mayor pro tem, shall have the authority and power to reduce the currently existing speed limits within the city under the following conditions:
(1) The director of public works, chief of police, and city engineer report to the mayor that the conditions upon the public streets are of such a hazardous nature as to require the reduction of the existing speed limits pursuant to the authority and conditions stated within RCW 46.61.400, RCW 46.61.415, or other provisions of state law.
(2) Upon receipt of the above-stated report, the mayor or the mayor pro tem, as the case may be, shall by executive order establish the speed limit to be imposed, taking into consideration the conditions then existing.
(3) Upon the establishment of the limit pursuant to subsection(2) B of this section, the city shall take immediate steps to post and otherwise publicize the newly established limits; provided, that to the extent allowed by law, the speed limit shall take effect immediately upon its establishment by the issuance of the executive order.
(4) The mayor or mayor pro tem, as the case may be, shall report the action taken to the city council at its next regular or special meeting at which time, if the limits imposed are still in effect, the council may either ratify the limit or limits or remove the same.
(5) The limit or limits established pursuant to executive order shall remain in full force and effect until it is determined by the mayor or mayor pro tem that conditions have improved to the extent that they are no longer required or until the council has taken action pursuant to subsection (4) of this section. 9.12.020 Penalty for violation.
Any violation of any of limits imposed by, under, or pursuant to the terms of this chapter shall be punished as provided in Section 1.08.030. (Ord. 1134 §3, 1980).
