16.16.010 Submission procedures--Form.

(a)    Within the approval period prescribed in this chapter, the subdivider shall file with the city clerk-controller a final plat, which shall be drawn in the manner required by the provisions of this section and shall contain the information, certificates and statements required by this title. The plat scale shall neither be less than fifty feet to the inch, nor more than one hundred feet to the inch. All plats shall be drawn in the manner provided by subsection (b) of this section.

(b)    In recognition of the necessity of the filing of all plats with the office of the auditor of Grays Harbor County and in further recognition of the advantages of consistency and uniformity, all plats submitted to the city shall be drawn in such manner and form as is adopted by the county of Grays Harbor for the filing of such plats and such conformance as to form shall be a condition precedent to a requirement that the city accept the plat. 16.16.020 Required information.

The final plat shall contain or be accompanied by the following information:

(1)    The primary control point approved by the city engineer, and descriptions and ties to such control points to which all angles, bearings, dimensions and similar data on the plat shall be referred;

(2)    All tract boundary lines, right-of-way lines of streets, easements and other rights-of-way, and property lines of lots and other sites, with street centerlines and property lines, and other information necessary to reproduce the plat on the ground. Dimensions shall be shown from all angle points and points of curve to lot lines;

(3)    The name and right-of-way width of each street, and other rights-of-way;

(4)    The location, dimensions and purposes of each easement;

(5)    The purpose for which sites, other than residential lots, are dedicated or reserved;

(6)    Numbers to identify each parcel, lot and block;

(7)    The location and description of all monuments. Permanent control monuments shall be established at each and every controlling corner on the boundaries of the land being subdivided. The city engineer shall determine the number and location of permanent control monuments within the plat, if any;

(8)    References to recorded plats of adjoining land by record name, date and number. (Ord. 979 §4.02, 1975).

16.16.030 Recommendations for approval.

Each and every plat submitted for final approval of the city council shall be accompanied by the following agencies' written recommendations for approval or disapproval:

(1)    The environmental health division, Grays Harbor County department of public services, as to the adequacy of the proposed means of sewage disposal and water supply;

(2)    The city engineer and the public works superintendent. (Ord. 1367 §24, 1995: Ord. 979 §4.03, 1975).

16.16.040 Requirements for each plat or replat filed for record.

(a)    Each and every plat, or replat, or any property for which final approval is requested of the city council and which is to be filed for record shall:

(1)    Contain a statement of approval from the city licensed engineer, or by a licensed engineer acting on behalf of the city, as to the survey data, the layout of streets, alleys and other rights-of-way, design of bridges, sewage and water systems, and other structures;

(2)    Be accompanied by a complete survey of the section or sections in which the plat or replat is located or as much thereof as may be necessary to properly orient the plat within such section or sections. The plat and section survey shall be submitted with complete field and computation notes showing the original or re-established corners with descriptions of the same and the actual traverse showing error of closure and method of balancing. A sketch showing all distances, angles and calculations required to determine corners and distances of the plat shall accompany this data. The allowance of error of closure shall not exceed one foot in five thousand feet;

(3)    Be acknowledged by the person filing the plat before the auditor of Grays Harbor County, or any other officer who is authorized by law to take acknowledgments of deeds, and a certificate of said acknowledgment shall be enclosed or annexed to such plat and shall be recorded therewith;

(4)    Contain a certificate from the proper officers in charge of tax collections that all taxes and delinquent assessments for which the property may be liable as of the date of certification have been duly paid, satisfied, or discharged;

(b)    No engineer who is connected in any way with the subdividing and platting of land for which subdivision approval is sought shall examine and approve such plat on behalf of the city. (Ord. 979 §4.04, 1975).

16.16.050 Certificates required when.

(a)    Every final plat or short plat of a subdivision or short subdivision filed for record must contain a certificate giving a full and correct description of the lands divided as they appear on the plat or short plat, including a statement that the subdivision or short subdivision has been made with the free consent of and in accordance with the desires of the owner or owners.

(b)    If the plat or short plat includes a dedication, the certificate shall also contain the dedication of all streets and other areas to the public, and individual or individuals, religious societies, or to any corporation public or private, as shown on the plat or short plat, and a waiver of all claims for damages against any governmental authority which may be occasioned to the adjacent land by the established construction, drainage, or maintenance of roads. The certificate shall be signed and acknowledged before a notary public by all parties having any interest in the land subdivided.

(c)    Every plat and short plat containing a dedication filed for record must be accompanied by a title report conforming that the title to the lands as described and shown on said plat is in the name of the owners signing the certificate.

(d)    An offer of dedication may include a waiver of right of direct access to any street from any property, and if the dedication is accepted, any such waiver is effective. Such waiver may be required by the city council as a condition of approval. Roads not dedicated to the public must be clearly marked on the face of the plat. Any dedication, donation or grant as shown on the face of the plat shall be considered to all intents and purposes as a quitclaim deed to the donee or donees, grantee or grantees, for his, her or their use for the purpose intended by the donors or grantors as aforesaid. 16.16.060 Additional certificates and documentation required.

Required certificates and statements. (a) Each sheet of the plat shall contain the following registered land surveyor's certificate: registered land surveyor, hereby certify that the plat of as shown hereon is based upon actual field survey of the land described and correctly shown and that the monuments have been set and the lot corners staked as shown on the plat.

(b)    The city council may require additional certificates, affidavits, or endorsements, as they may become necessary, for the reasonable enforcement of these regulations.

(c)    Each plat shall be accompanied by a copy of all restrictive covenants and other deed restrictions that are to be placed upon any of the lots in the subdivision. (Ord. 979 §4.06, 1975).

16.16.070 Approval of city engineer.

Upon the receipt of the final plat, the administrator shall deliver the plat to the city engineer for his approval. The city engineer shall determine whether the plat is accurate and correct in all details and whether it and the subdivision comply with the general law and the provisions of this title. If necessary, the city engineer may cause a field inspection to be made, and the costs of such inspection shall be charged to the applicant, at prevailing rates, and shall be paid before the city engineer approves the plat. If the city engineer approves the plat, he shall so certify on the plat. If he does not approve, he shall state in writing the specific reasons for his disapproval. After approval or disapproval, the city engineer shall deliver the plat to the administrator. If the city engineer has not approved the plat, the same shall be returned to the subdivider for the corrections or changes necessary to comply with the city engineer's objections. Thereafter, the subdivider may resubmit the final plat. (Ord. 1367 §25, 1995: Ord. 979 §4.07, 1975).

16.16.090 Council approval authoritv--Copies and recording procedures required--Notice of disapproval when.

(a)    If the city council at a regular meeting finds that the public use and interest will be served by the proposed subdivision and that the same meets the requirements of state law and of this title adopted pursuant thereto, it shall enact an ordinance to that effect and shall suitably inscribe and execute its written approval upon the face of the plat. The original of the final plat shall be filed for record with the Grays Harbor County auditor. One reproducible copy shall be furnished to the city engineer. One paper copy shall be filed with the Grays Harbor County assessor. Paper copies shall be provided for the city clerk, public works superintendent, building inspector, and such other city departments as may have need for the same.

(b)    Any lots in a final plat approved by the city council and filed for record with the auditor as provided in this section shall be a valid land use notwithstanding any change in zoning laws, or ordinances of the city, for a period of five years from the date of filing for record.

(c)    If the city council disapproves the proposed plat and subdivision, the city clerk-controller shall so notify the applicant in writing within five days of said disapproval and shall transmit to the applicant a written statement of the findings of the city council setting forth reasons for such disapproval.
