17.04.010 Title.
The ordinance codified in this title shall be known as the "Montesano Zoning Ordinance." (Ord. 1366 (part), 1995).
17.04.020 Purpose.
This title is an official land use control for the city of Montesano, state of Washington, adopted and established as a means of implementing the goals, objectives and policies of the Montesano comprehensive plan, which serves the public health, safety and general welfare and encourages the most appropriate use of land. (Ord. 1366 (part), 1995).
17.04.030 Interpretation of title.
In their interpretation and application, the provisions of this title shall be held to be the minimum requirements for the promotion of the public health, safety, morals and general welfare; therefore, where this title imposes a greater restriction upon the use or development of land, buildings or premises than is required by other laws, ordinances, rules or regulations, the provisions of this title shall apply. However, except as provided in this title, it is not intended by this title to abolish or in any way interfere with any existing provision of law, regulation, permit, easement, covenant or other agreement between parties previously issued related to the use of buildings or land, and such provision shall apply unless provisions within this title impose greater restrictions upon the use, erection, moving or alteration of buildings or land. (Ord. 1366 (part), 1995).
17.04.040 Conflicts between codes.
The following principle shall guide construction of the terms and conditions of the land use regulations adopted pursuant to the provisions of this title: in the event of conflict among the provisions of this title, the more restrictive or stringent provision shall be deemed controlling. (Ord. 1366 (part), 1995).
