PROHIBITED ANIMALS AND CONDUCT

6.18.010 Livestock.

It shall be unlawful for any person to:

A.    Harbor or possess livestock, except:

1.    Female chickens may be harbored as allowed under Section 6.16.050; and

2.    Goats and/or sheep may be temporarily harbored for the purpose of vegetation control:

a.    For no more than ninety days in any calendar year; and

b.    On property restricted for stormwater, open space, park, utility or similar uses that is owned, used or controlled by a public municipality, special district or utility; and

c.    Provided they are tethered or harbored within a securely fenced area.

B.    Ride or drive any livestock over, along or across any principal arterial streets or right-of-way, including sidewalks, except with prior written authorization of the city administrator.

C.    Ride or drive any livestock on a principal arterial as designated by the city of Mukilteo transportation plan or on any sidewalk or to be within or on any public park, beach or playground within the city of Mukilteo, except with prior written authorization of the city administrator. 6.18.020 Birds.

It shall be unlawful for any person to harbor:

A.    Poultry, other than female chickens as allowed under Section 6.16.050;

6.18.035 Feeding of wild animals.

It shall be unlawful for any person, other than any public officer or public employee in the performance of his or her duties, to:

A.    Deposit, place, distribute, or leave any foodstuffs of any kind or nature on public property, or property subject to city right-of-way, or property subject to easement or other agreement giving the city control or use of the property, save and except in a receptacle provided by the city for that purpose.

B.    Feed any wild animals, including, but not limited to, birds or waterfowl, on public property, or property subject to city right-of-way, or property subject to easement or other agreement giving the city control or use of the property. (Ord. 1267 § 4 (Exh. C) (part), 2011)

6.18.040 Penalties.

A.    Civil Infractions. Any person violating any of the provisions of this chapter is guilty of a civil infraction subject to the provisions contained in Section 1.32.020, Civil infractions. The first offense shall be a Class III civil infraction. The second offense shall be a Class II civil infraction. The third offense shall be a Class I civil infraction.

B.    Misdemeanors. Any person who violates the provisions of this chapter more than three times within a five-year period shall be guilty of a misdemeanor subject to the provisions contained in Section 1.32.010(B). (Ord. 1267 § 4 (Exh. C) (part), 2011: Ord. 1105 § 2 (part), 2004)
