9.58.010 Definitions.

A.    Whenever used in this chapter, “skateboard” means a short board composed of wood, plastic or other substitute to which is attached a set of rollerskate wheels or other similar wheels, which device is used primarily by children at play, and is usually propelled along a smoothly paved, hard surface by the user who sometimes stands, sits, kneels or lays upon the device while it is in motion.

B.    For the purpose of this chapter, “to operate in a negligent manner” means the operation of the skateboard in such a manner as to endanger or to be likely to endanger any persons or property, including, but not limited to, the person or property of the operator. (Ord. 708 § 35 (part), 1991)

9.58.020 Negligent operation of skateboards prohibited.

It is unlawful for any person to operate a skateboard in a negligent manner upon any roadway, sidewalk, publicly owned parking lot, or other pedestrian or vehicular way open to the public whether publicly or privately owned, or other public property. (Ord. 708 § 35 (part), 1991)

9.58.030 Responsibility of parents and guardians.

It is unlawful for any parent, guardian or person standing in the place of a parent or guardian to knowingly permit any child under the age of eighteen years to operate a skateboard in a negligent manner upon any roadway, sidewalk, publicly owned parking lot, other pedestrian or vehicular way open to the public whether publicly or privately owned, or other public property. 9.58.040 Violation—Penalty.

Violations of this chapter shall be subject to the civil infraction penalties outlined in Mukilteo Municipal Code Chapter 1.32, General Penalties. The first violation shall constitute a Class III civil infraction, the second offense shall constitute a Class II civil infraction, and the third and each violation thereafter within a one-year period shall be classified as a Class I civil infraction. Community service hours up to a maximum of fifty hours may be imposed in lieu of all or part of a monetary penalty, with each hour being credited against the monetary penalty at the rate of five dollars per hour. In addition, the skateboard may be confiscated by the chief of police to be held until further order of the court. (Ord. 1083 § 15, 2003: Ord. 708 § 35 (part), 1991)
