This matter came before a three-judge panel of the Nez Perce Tribal Court of Appeals pursuant to Respondent’s October 12, 1995 Objection to the removal of Justice John Roe as Appellate Judge in this case.
This matter is an immediate appeal filed pursuant to Nez Perce Tribal Law and Order Code, § 2-4-10. Section 2-4-10 provides that “one member of the Appellate Court shall hear an immediate appeal”. Pursuant to an August 28, 1995 Order, Justice Roe is the judge assigned to hear this matter. Justice Roe has not issued a final judgment regarding the appeal; therefore, there is no final reviewable order before us at this time.
Therefore, based on the foregoing, it is hereby ordered that this matter is remanded to Justice John Roe to complete his review of the file and issue a final judgment.
If the parties wish to appeal the final judgment, they may do so pursuant to the provisions of Nez Perce Law and Order Code, section 2-4-11.
