2.47.010 Establishing the Newport police department and designating the department as a criminal justice agency for the city of Newport.

A. There is established in the city a police department to be known as the Newport police department. The Newport police department shall be a criminal justice agency for the city of Newport.

B. The police department shall be under the direction of a chief of police who will be the city’s chief law enforcement officer in accordance with RCW 35A.12.020.

C. The department shall be responsible to the mayor for effective law enforcement and shall have all the powers and perform such other duties as provided by the laws of the state, ordinances, and resolutions, and as directed by the mayor.

D. The mayor shall appoint the police chief as provided by law and the appointment is subject to confirmation by the city council.

E. The chief of police shall be responsible to the mayor or the mayor’s designee for management of the police department and supervision and training of departmental employees. (Ord. 2043 § 1, 2018)

2.47.020 Civil service – Chapter 2.48 NMC prevails when.

The provisions of Chapter 2.48 NMC shall prevail, except as to the chief of police, regarding the hiring, promotion, demotion or discharge of personnel in cases of any conflict with this chapter. (Ord. 2043 § 1, 2018)

2.47.030 Chief of police – Powers and duties – Generally.

There is created and established the position of chief of police of the city. The chief of police shall be appointed by the mayor, subject to confirmation by the city council. The chief of police shall take an oath of office to faithfully defend the Constitution of the United States of America, the Constitution of the State of Washington, and the laws thereunder, including all ordinances of the city. The chief shall have charge and supervision of all personnel and property devoted to the use of the police department. The chief shall enforce the rules and regulations governing the organization of the department, and may make such rules and regulations reasonably necessary for the conduct of the department. 2.47.040 Chief of police – Attendance at council meetings.

The chief of police, or his delegate, shall attend meetings of city council when requested. (Ord. 2043 § 1, 2018)

2.47.050 Subordinate positions.

In addition to the position of chief of police, there is established the position of patrol officer and the city council shall have the power to approve funding for this position and to grant the authority to hire for this position. (Ord. 2043 § 1, 2018)

2.47.060 Salaries.

The chief of police and other city police officers, if any, shall be paid such salary as may annually be fixed by the city council. (Ord. 2043 § 1, 2018)

2.47.070 Professional obligation of all officers.

All personnel of the police department should thoroughly familiarize themselves with the provisions of the city code, and shall carry out their services to the city with pride in their profession, courtesy and courage in the prosecution of their duties, discretion in the investigation and prosecution of cases, and fidelity to city, state and federal government.
