RECOVERY OF FILING FEES

2.76.010 Appeals.
If a citizen appeals the administrative decision of the planning department to the hearing examiner which has authority to sustain, reverse or modify the administrative decision, and if the citizen prevails on appeal, then the filing fee for the appeal shall be refunded to the citizen; provided, that the following condition is met:
The appeal is granted upon the hearing examiner’s consideration of the same evidence and argument that had been presented to the planning department administrator, and no new issues, evidence or argument are presented on appeal. (Ord. 833 § 1, 2009; Ord. 687 § 1, 2002).
