7.04.010 Title.
This chapter and NPMC Title 7 shall be known as and may be cited as the Normandy Park Criminal Code. (Ord. 332 § 1(a), 1978).
7.04.020 Preliminary article.
The following provisions of the Washington Criminal Code are adopted by reference as the preliminary article of the Normandy Park Criminal Code: RCW 9A.04.020; 9A.04.050; 9A.04.060; 9A.04.100; and 9A.04.110. (Ord. 332 § 1(b), 1978).
7.04.030 Principles of liability.
The following provisions of the Washington Criminal Code are adopted by reference as principles of liability of the Normandy Park Criminal Code: RCW 9A.08.010 through 9A.08.030, inclusive. (Ord. 332 § 1(c), 1978).
7.04.040 Anticipatory offenses.
The following provisions of the Washington Criminal Code are adopted by reference as anticipatory offenses: RCW 9A.28.020 through 9A.28.040, inclusive. (Ord. 332 § 1(g), 1978).
7.04.050 Defenses to culpability.
The following provisions of the Washington Criminal Code are adopted by reference as defenses to culpability: RCW 9A.16.010 through 9A.16.090, inclusive. (Ord. 448 § 1, 1985; Ord. 332 § 1(e), 1978).
7.04.060 Defense of insanity.
The following provisions of the Washington Criminal Code are adopted by reference as the defense of insanity: RCW 9A.12.010. (Ord. 332 § 1(d), 1978).
7.04.070 Obstructing governmental operations.
The following provisions of the Washington Criminal Code are adopted by reference to establish crimes involving obstructing governmental operation: RCW 9A.76.010; 9A.76.030 through 9A.76.060 inclusive; 9A.76.080; 9A.76.100; 9A.76.130; and 9A.76.170(1). (Ord. 436 § 1, 1984; Ord. 332 § 1(o), 1978).
7.04.075 Obstructing public officers.
It is unlawful for any person to make any wilfully untrue, misleading or exaggerated statement, or to wilfully hinder, delay or obstruct any public officer in the discharge of his official powers and duties. (Ord. 436 § 2, 1984).
7.04.080 Abuse of office.
The following provisions of the Washington Criminal Code are adopted by reference to establish the crime of abuse of office: RCW 9A.80.010. (Ord. 332 § 1(p), 1978).
7.04.090 Criminal impersonation.
The following provisions of the Washington Criminal Code are adopted by reference to establish the crime of criminal impersonation: RCW 9A.60.040. (Ord. 332 § 1(m), 1978).
7.04.100 Unlawful imprisonment and custodial interference.
The following provisions of the Washington Criminal Code are adopted by reference to establish the crimes of unlawful imprisonment and custodial interference: RCW 9A.40.010; 9A.40.040; and 9A.40.050. (Ord. 332 § 1(i), 1978).
7.04.110 Public disturbance.
The following provisions of the Washington Criminal Code are adopted by reference to establish the crime of public disturbance; RCW 9A.84.020 through 9A.84.040, inclusive. (Ord. 332 § 1(q), 1978).
7.04.120 Public indecency and prostitution.
The following provisions of the Washington Criminal Code are adopted by reference to establish the crime of public indecency and crimes of prostitution: RCW 9A.88.010 through 9A.88.050; 9A.88.080; and 9A.88.090. (Ord. 332 § 1(r), 1978).
7.04.130 Assault and other crimes involving physical harm.
The following provisions of the Washington Criminal Code are adopted by reference to establish the crime of assault and other crimes involving physical harm: RCW 9A.36.041, 9A.36.050 and 9A.36.070, inclusive. (Ord. 488 § 1, 1988; Ord. 448 § 2, 1985; Ord. 332 § 1(h), 1978).
7.04.140 False swearing and tampering with physical evidence.
The following provisions of the Washington Criminal Code are adopted by reference to establish the crimes of false swearing and tampering with physical evidence: RCW 9A.72.010; 9A.72.040 through 9A.72.080, inclusive; and 9A.72.150. (Ord. 332 § 1(n), 1978).
7.04.150 Controlled substances and glue-sniffing.
The following provisions of the Washington Criminal Code are adopted by reference to establish the crime of possession of marihuana and the crime of glue-sniffing: RCW 69.50.101(n); 69.50.401(d); 69.50.407; and 9.47A.010 through 9.47A.050. (Ord. 332 § 1(s), 1978).
7.04.160 Theft.
The following provisions of the Washington Criminal Code are adopted by reference to establish crimes of theft: RCW 9A.56.010; 9A.56.020; 9A.56.050 through 9A.56.070; 9A.56.090; 9A.56.100; 9A.56.140; 9A.56.170; and 9A.56.180. (Ord. 332 § 1(l), 1978).
7.04.170 Reckless burning and malicious mischief.
The following provisions of the Washington Criminal Code are adopted by reference to establish the crimes of reckless burning and malicious mischief: RCW 9A.48.010; 9A.48.050; 9A.48.060; 9A.48.090; 9A.48.100; 9.61.160; 9.61.170; and 9.61.230 through 9.61.250, inclusive. (Ord. 332 § 1(j), 1978).
7.04.180 Trespass.
The following provisions of the Washington Criminal Code are adopted by reference to establish the crime of criminal trespass: RCW 9A.52.010; 9A.52.060; 9A.52.070; and 9A.52.080 through 9A.52.100, inclusive. (Ord. 332 § 1(k), 1978).
7.04.185 Criminal code.
The following chapters and sections of the Revised Code of Washington and Washington Administrative Code (“RCWs” and “WACs”), as existing now or as amended hereafter, are hereby adopted by reference as though they were set forth fully herein. 7.04.190 Classification of crimes and penalties.
Every violation of the Normandy Park Municipal Code is either an infraction or a misdemeanor, and shall be punished by the greater of the penalty prescribed by state statute for the same offense, or the penalty prescribed by the relevant NPMC section. The court may require restitution in lieu of the fine, pursuant to RCW 9A.20.030, which is adopted by reference. (Ord. 725 § 3, 2004; Ord. 332 § 1(f), 1978).
7.04.200 Limitation of actions.
Prosecution of any offense defined in the Normandy Park Criminal Code must be commenced within one year after commission of the offense; provided, that any length of time during which the party charged was not usually and publicly resident within this state shall not be reckoned within the one-year period; and provided further, that where an indictment has been found, or complaint or an information filed, within the one-year period, if the indictment, complaint or information is set aside, the time of limitation shall be extended by the length of time from the time of filing of such indictment, complaint or information, to the time such indictment, complaint, or information was set aside. 7.04.210 Filing.
Incident to the adoption of provisions of the Washington Criminal Code by this chapter, copies of the text of the statutes adopted by reference shall be filed as required by RCW 35A.12.140 and 35A.13.180 for use and examination by the public. (Ord. 883 § 8, 2012; Ord. 332 § 1(u), 1978).
