I. County Authority

8.36.010 Authority designated.

The King County disposal system is designated as the authority governing the disposal of all solid waste, including moderate risk waste, generated or collected within the city. The county is designated as the authority to designate appropriate solid waste disposal sites, except for solid waste eliminated through waste reduction and recycling programs consistent with the county and the city comprehensive solid waste management plans. (Ord. 773 § 1, 1988).

8.36.020 Diversion when.

No solid waste as defined by the King County comprehensive solid waste management plan may be diverted from disposal consistent with the terms of the King County comprehensive solid waste management plan without the prior approval of King County. (Ord. 773 § 2, 1988).

8.36.030 Violation – Penalty.

Any person who violates the terms of this chapter is guilty of a misdemeanor. Upon conviction, a person violating the terms of this chapter is punishable by a fine of $500.00, or a term of imprisonment of six months, or both such fine and imprisonment. (Ord. 773 § 3, 1988).

II. County Management Plan

8.36.100 Adoption of plan.

The council hereby adopts King County’s Proposed Comprehensive Solid Waste Management Plan, dated July, 1990, as amended by Attachment A as recommended by the Solid Waste Interlocal Forum through Resolution No. 89-005. (Ord. 813 § 1, 1990).

8.36.110 City franchise rights.

Pursuant to RCW 70.95.160, the council reserves the right to franchise and otherwise regulate haulers of solid waste in the city, including to establish minimum levels and types of service and recycling collection rates for solid waste handling in the city, consistent with the objectives of state law and the solid waste management plan. (Ord. 813 § 2, 1990).
