14.13.010 Search warrants.
If the supervisor has been refused access to a building, structure or property, or any part thereof, and is able to demonstrate probable cause to believe there may be a violation of this title, or that there is a need to inspect as part of a routine inspection program of the city designed to verify compliance with this title or order issued hereunder, or to protect the overall public health, safety and welfare of the community, then the supervisor shall seek issuance of a search and/or seizure warrant from the Oak Harbor municipal court. Such warrant shall be served at reasonable hours by the supervisor in the company of a uniformed police officer of the city. (Ord. 1323 § 61, 2002; Ord. 1004, 1995).
14.13.020 Sewer service penalties, damages and enforcement measures.
(1) Criminal Penalty. Any person knowingly or intentionally violating any provision of this title shall be deemed guilty of a gross misdemeanor and, upon conviction thereof, shall be punishable by a fine not to exceed $5,000 or by imprisonment in jail not to exceed 364 days, or both such fine and imprisonment.
Each separate day, or any portion thereof, during which any violation of this chapter occurs or continues shall be deemed to constitute a separate offense and, upon conviction thereof, shall be punishable as provided in this section.
(2) Civil Infraction. Any person otherwise violating any provision of this title shall be deemed to have committed a Class 1 infraction as defined in Chapter 1.28 OHMC.
Each separate day, or any portion thereof, during which any violation of this chapter occurs or continues shall be deemed to constitute a separate offense and, upon conviction thereof, shall be punishable as provided in this section.
(3) Injunction. In addition to the foregoing criminal remedy, the violation of any of the provisions of this chapter is deemed to be a nuisance and threatening to the health and safety of the citizens of Oak Harbor. The city may utilize any civil remedy available to it under the laws of the state of Washington to enforce these provisions, including injunctive relief.
(4) Civil Damages. Any person violating any of the provisions of this chapter shall become liable to the city for any direct or indirect expense, loss or damage occasioned by the city by reason of such violation. (Ord. 1717 § 30, 2015; Ord. 1323 § 62, 2002; Ord. 1137 § 1, 1998; Ord. 1004, 1995).
