18.82.010 Findings.

Pursuant to RCW 69.50.331.8(b) the city of Okanogan finds that the reduction of buffers separating establishments licensed by the state of Washington to produce, process, research, transport, or deliver marijuana, usable marijuana, marijuana concentrates, or marijuana-infused products subject to the regulations established under RCW 69.50.385, or sell marijuana from public parks, recreation/community centers, libraries, child care centers, game arcades and public transit centers will not negatively impact the city’s civil regulatory enforcement, criminal law enforcement interests, public safety, or public health of the city of Okanogan. 18.82.020 Authorization.

The city of Okanogan authorizes the Washington State Liquor and Cannabis Board to issue licenses consistent with the distance requirements of this chapter. (Ord. 1179 § 2, 2017)

18.82.030 Distance regulations specified.

The city of Okanogan establishes the following distance separations (buffers) for establishments licensed by the state of Washington to produce, process, research, transport, or deliver marijuana, usable marijuana, marijuana concentrates, or marijuana-infused products subject to the regulations established under RCW 69.50.385, or sell marijuana as follows:

A. Public parks – 100 feet.

B. Recreation or community centers – 100 feet.

C. Libraries – 100 feet.

D. Child care centers – 100 feet.

E. Game arcades – 100 feet.

F. Public transit centers – 100 feet.

For purposes of this chapter and implementing these standards, the terms used are defined in and the methodology for measuring the buffers shall be as provided in Chapter 314-55 WAC. It shall be the responsibility of the owner or operator of the proposed state-licensed marijuana use to demonstrate and ensure that a proposed location is not within one of the buffers.
