10.72.010 Definitions

A.    "Cruising" means the passage of a motor vehicle past a traffic control point on a public street within the city, which passage occurs more than two times in the same direction of travel within a two-hour period.

B.    "Traffic control point" means any point or points on streets designated for no cruising, selected by the police department for the purpose of monitoring cruising.

C.    "Traffic congestion" means a level of vehicular traffic on a street which significantly impedes the free passage of vehicles and/or pedestrians on any rights-of-way or which significantly obstructs vehicular or pedestrian access to property abutting said street.

10.72.020 Cruising prohibited

A.    No person shall drive a motor vehicle or permit a motor vehicle under his or her care or control to be driven in a manner which constitutes cruising as defined herein, when such cruising causes or contributes to traffic congestion. No violation shall occur except upon passage by a motor vehicle by the same traffic control point in the same direction of travel within the aforementioned two-hour period.

10.72.030 Signage

At critical points within the city, the city shall erect signs which indicate that cruising is prohibited.

10.72.040 Exemptions

The provisions of this chapter shall not apply to:

A.    Any publicly owned vehicle of any city, county, public district, state or federal agency;

B.    Any vehicle licensed for public transportation, including but not limited to buses and taxi cabs;

C.    Any in-service emergency vehicle;

D.    Any vehicle driven by a resident of the designated no cruising area or any vehicle being driven within the no cruising area for necessary commercial or medical reasons.

10.72.060 Penalty

Violation of this chapter shall constitute a traffic infraction, subjecting any violator to a civil penalty of not less than fifty dollars nor more than one hundred dollars for a first offense, and not less than one hundred dollars nor more than two hundred fifty dollars for subsequent offenses.
