9.28.020 - Possession of or under the influence of –Unlawful

It is unlawful for any person to be in possession of or under the influence of any drug or other controlled substance as defined or scheduled in RCW Chapter 69.50.

9.28.030 - Presumption of intent to sell

In any prosecution under this chapter, proof that any person unlawfully possesses in excess of forty grams of marijuana shall raise a rebuttable presumption that possession was with intent to sell.

9.28.040 - Aiding and abetting –Penalty for violation

Any person who counsels, aids or abets a violation of this chapter is guilty of a misdemeanor and upon conviction may be punished by a fine not exceeding five hundred dollars or by imprisonment not exceeding ninety days or by both such fine and imprisonment.

9.28.050 - Bar to prosecution

Any conduct or condition which constitutes a violation of this chapter which has been the basis of a conviction under a state law, federal law, or the law of another state shall not be punishable under this chapter.

9.28.060 - Penalty imposed under this chapter is in addition to other penalties

Any penalty imposed for violation of this chapter is in addition to, and not in lieu of, any civil or administrative penalty or sanction otherwise imposed by law.
