2.88.010 Creation of office of hearing examiner.

The office of land use hearing examiner is hereby created. The examiner shall interpret, analyze, review, and implement land use regulations and shall have the jurisdiction, duties and powers as set forth in Title 18 of the Omak Municipal Code entitled “Zoning.” (Ord. 1562 § 1, 2006).

2.88.020 Hearing examiner—Appointment—Term.

The mayor shall appoint, with the consent of the council, a hearing examiner. Said office shall be for a term of four years following the date of original appointment and/or reappointment. (Ord. 1562 § 2, 2006).

2.88.030 Hearing examiner—Qualifications.

The hearing examiner shall be appointed solely with regard to his or her qualifications for the duties of the office, which shall include persons with appropriate experience, such as land use planners, or public administrators, persons who have extensive experience in land use planning work in a responsible capacity, and persons with legal experience, particularly where that experience is in the area of land use management or administrative law. Any appointed hearing examiner may be removed by the mayor, subject to the approval of the council. (Ord. 1562 § 3, 2006).
