STREET IMPROVEMENT REIMBURSEMENT AREAS

11.40.010 Reimbursement for city made street improvements.

Whenever the city has elected to make improvements to any city street or way beyond the scope of normal maintenance, the city may seek reimbursement for such improvement by creating a right of reimbursement for such charges. Pursuant to RCW 35.72.040 - .050, the city has defined each of the assessment reimbursement areas described herein. The city council has determined the city is entitled to assess the reimbursement associated with each assessment reimbursement area described in this chapter. (Ord. 1120 § 1 (part), 2002).

11.40.020 Triggering event.

In the event any person shall apply for a building permit, development permit or permission, including filing a preliminary plat, or shall under take any development on land included within any of the described assessment reimbursement areas in this chapter, then the land owner shall be obligated to pay to the city a reimbursement for street improvements previously made by the city as set forth in each assessment reimbursement area in this chapter. 11.40.030 Assessment reimbursement areas.

The following assessment reimbursement areas have been created by the city council and those areas are subject to the reimbursement assessment set forth for each such area.

(1)    The assessment reimbursement area is all industrial property on both sides of Lee Street from a point one thousand two hundred feet East of the intersection of Lee Street and Broadway Avenue to a point three thousand two hundred feet East of the intersection of Lee Street and Broadway Avenue, a distance of two thousand feet. The reimbursement assessment for this assessment reimbursement area is established at one hundred dollars per linear foot of frontage on Lee Street. That per front foot reimbursement rate shall be adjusted upward commencing on June 1, 2003, by the change in the January to January All West Coast Cities CPI-W Index issued in 2003, and shall be so adjusted each June 1, thereafter using the same index or its successor, as determined by the city.

(2)    The assessment reimbursement area is all property on the west side of North Broadway Avenue (McManamon Road) from Lee Street to a point one thousand one hundred forty-three feet north of the center of Lee Street. The reimbursement assessment for this reimbursement area is established at sixty-eight dollars per linear foot of frontage of North Broadway Avenue. That per front foot reimbursement rate shall be adjusted upward commencing on June 1, 2003, by the change in the January to January All West Coast Cities CPI-W Index issued in 2003, and shall be so adjusted each June 1, thereafter using the same index or its successor, as determined by the city.

Any entity paying this reimbursement amount which is also an employer may seek a refund of a portion of the reimbursement amount paid. Such refund is allowed, funds permitting, on the following basis:

Employers will receive a rebate for every new employee position created as a result of the development which triggered the payment of the reimbursement amount. Such positions must have been full time positions with the employer for at least one year. Such employee positions must be non-agriculture related. Non-agricultural jobs are those jobs not directly dependent on growing, harvesting or processing food stuffs. Any rebate is based on the number of full time family wage nonagricultural jobs existing and paid for a period of at least twelve months. A family wage job as per the Northwest Policy Center and Northwest Federation of Community Organizations is as follows:

1.    For a single adult household, twenty-one thousand three hundred twenty-two dollars a year or ten dollars and twenty-five cents an hour.

2.    For a single adult with one child, twenty-seven thousand two hundred eighty-eight dollars a year or thirteen dollars and twelve cents an hour.

3.    For a single adult with two children, thirty-five thousand seventy-nine dollars a year or sixteen dollars and eighty-six cents an hour.

4.    For two adults, one of whom is working, with two children, twenty-nine thousand twenty-three dollars a year or thirteen dollars and ninety-five cents an hour.

5.    For two adults, both of whom are working, with two children thirty-eight thousand three hundred sixty-nine dollars a year or eighteen dollars and forty-five cents an hour (which means that the combined wages of both working adults needs to total this amount.) adjusted annually per the CPI-W.

The rebate fee is established at one thousand dollars per qualifying employee position to a maximum amount equal to the reimbursement amount paid.

For example: Employer paid a reimbursement amount of twenty five thousand dollars per this section of the code, has employed ten full time non-agricultural employees for more than twelve months at family wage level jobs related to the development that triggered the reimbursement payment, then the rebate would be ten thousand dollars.
