15.04.010 Adopted.

In compliance with Chapter 19.27 RCW, the following codes, standards, and Washington Administrative Code (WAC) provisions are hereby adopted by reference, as the same exist now or may be hereinafter amended:

A.    International Building Code. The current edition of the International Building Code, including Appendices H and J, published by the International Code Council (ICC) as adopted by the State Building Code Council as set forth in WAC Title 51 is adopted as the building code for the city. To the extent other provisions of the Pateros Municipal Code currently refer to the Uniform Building Code, all such references shall hereafter be interpreted as references to the International Building Code as adopted in this section.

B.    International Residential Code. The current edition of the International Residential Code, including Appendices G and J, published by the International Code Council, Inc., as adopted by the State Building Code and as set forth in WAC Title 51 is adopted as the residential code for the city.

C.    International Mechanical Code. Except as provided in RCW 19.27.031, the current edition of the International Mechanical Code, including all appendices published by the International Code Council, Inc., as adopted by the State Building Code Council and as set forth in WAC Title 51, is adopted as the mechanical code for the city.

D.    Uniform Plumbing Code. Except as provided in RCW 19.27.031 and 19.27.170, the current editions of the Uniform Plumbing Code and Uniform Plumbing Code Standards published by the International Association of Plumbing and Mechanical Officials, and including all additions, deletions, and exceptions as set forth in WAC Title 51, as the same exist or may hereafter be amended, are adopted by this reference and incorporated herein as if fully set forth as the plumbing code of the city, except such portions as may be deleted, modified, or amended by ordinance.

E.    International Fire Code. Except as provided in RCW 19.27.031, the current edition of the International Fire Code, including Appendices B, C, D, E, F, and G, including those standards of the National Fire Protection Association specifically referenced in the International Fire Code, as published by the International Code Council, Inc., including all additions, deletions, and exceptions as set forth in WAC Title 51, as the same now exist or may be hereinafter amended, is hereby adopted by this reference and incorporated herein as though fully set forth as the fire code for the city, except such portions as may be deleted, modified, or amended by ordinance.

F.    Uniform Code for Abatement of Dangerous Buildings. The most current edition of the Uniform Code for Abatement of Dangerous Buildings, as published by the International Conference of Building Officials.

G.    Washington State Energy Code. The current edition of the Washington State Energy Code, as adopted by the State Building Code Council, and as set forth in WAC Title 51.

H.    Washington State Ventilation and Indoor Air Quality Code. The current edition of the Washington State Ventilation and Indoor Air Quality Code as adopted by the State Building Code Council, and as set forth in WAC Title 51.

I.    Washington State Historic Building Code. The current edition of the Washington State Historic Building Code as adopted by the State Building Code Council, and as set forth in WAC Title 51. (Ord. 06-646 § 1, 2006: Ord. 584 § 1, 1999: Ord. 508 § 1(f)—(i), 1992)

15.04.015 Construction standards adopted.

The 2006 Standard Specifications for Road, Bridge and Municipal Construction, published by the Washington State Department of Transportation, is hereby adopted by reference as it now exists or may be hereafter amended. (Ord. 06-648 § 1, 2006)

15.04.020 Conflicts.

Whenever any conflict occurs between any section of this chapter as amended and the codes referred to in this chapter, the first of the following named shall govern over those following:

A.    This chapter, as amended; provided, that the provisions set forth in this chapter must meet minimum mandatory standards set forth in the codes adopted by reference in this chapter.

B.    Building code.

C.    Residential code.

D.    Mechanical code.

E.    Fire code.

15.04.030 Consultant fees.

In addition to the building permit application and plan review fees that an applicant must submit pursuant to the Uniform Building Code, whenever review of a building permit application requires the retention by the city of professional consultant services, the applicant shall reimburse the city for the costs of such professional consultant services. The city may also require the applicant to deposit an amount with the city estimated, in the discretion of the city, to be sufficient to cover anticipated costs of retaining professional consultant services and to ensure reimbursement to the city for such costs. 15.04.040 Violation—Penalty.

A.    In addition to any remedies provided by any of the codes referred to in this chapter, failure to perform any act required, or the performance of any act prohibited by any of the codes referred to in this chapter, is designated to be a civil infraction and any person, firm or corporation found to have committed such an infraction by failing to perform any act required by said codes, or the performance of any act prohibited therein, shall be assessed a monetary penalty, which penalty may not exceed two hundred fifty dollars ($250.00) for each offense.

B.    Each day during which a violation continues shall be deemed a separate offense and penalties may be assessed for each separate offense.

C.    Nothing contained herein shall prevent the city from taking such other lawful action as is necessary to prevent or remedy any violation of codes referred to in this chapter. (Ord. 584 § 4, 1999)
