SMOKE-FREE PARK

8.20.010 Definition.
“Smoke” or “smoking” means the carrying or smoking of lighted pipe, cigar, cigarette, or any other lighted smoking equipment. (Ord. 864 § 1(C), 2012).
8.20.010 Prohibitions.
A. It is prohibited to smoke in the public park located at 351 S 15th Street when “No Smoking” banners are displayed during city-approved community events at the park.
B. The city council may maintain a standing list of approved community events and the mayor may approve one-time community events. (Ord. 864 § 1(A) and (B), 2012).
8.20.030 Violation – Penalty.
A. Any person intentionally violating this chapter by smoking in a public place or place of employment, or any person removing, defacing, or destroying a sign required by this chapter, is subject to a civil fine of up to $100.00. Any person passing by or through a public place while on a public sidewalk or public right-of-way has not intentionally violated this chapter. Local law enforcement agencies shall enforce this section by issuing a notice of infraction to be assessed in the same manner as traffic infractions.
B. When violations of this chapter occur, a warning shall first be given to the smoker. Any subsequent violation is subject to a civil fine of $25.00. Each day upon which a violation occurs or is permitted to continue constitutes a separate violation. (Ord. 864 § 1(D) and (E), 2012).
