9.36.010 Definitions.
In this chapter, unless the context otherwise requires, “package,” “liquor,” “consume,” “public place,” “interdicted,” “intoxicated” and “sell,” each mean as defined in the liquor laws of the state of Washington. (Ord. 364 §1, 1934).
9.36.020 Consumption – In public.
Except as permitted by the liquor laws of the state of Washington, no person shall open a package containing liquor or consume liquor in any public place. Every person who violates any provision of this section shall be guilty of a misdemeanor, and on conviction thereof shall be punished according to the provisions set forth in PMC 1.12.010. (Ord. 364 §2, 1934).
9.36.030 Intoxication in public place.
No person who is intoxicated shall be or remain in any public place, and no operator any public place where intoxicating liquor is sold shall permit any person who is intoxicated to remain therein and shall have notices posted to such effect. Every person who violates this section shall be liable on conviction for a first offense to a penalty of not more than $10.00; for a second offense to a penalty of not more than $25.00; and for a third or subsequent offense to imprisonment for not more than thirty days. 9.36.040 Sale or gift to intoxicated person.
No person shall sell or give liquor to any person apparently under the influence of liquor, or who has been declared an interdicted person or habitual drunkard. (Ord. 364 §4, 1934).
9.36.050 Sale or gift to persons under twenty-one.
No person shall sell or give any intoxicating liquor to any person under the age of twenty-one years, except as is permissible under the laws of the state of Washington, and any person violating the provisions of this section shall, upon conviction, be fined not less than $10.00 for each such violation. (Ord. 364 §5, 1934).
9.36.060 Sale or consumption in public places – Prohibition adopted by reference.
RCW 66.24.481 and any subsequent revisions or amendments prohibiting sale or consumption of alcoholic beverages in public places as defined by RCW 66.04.010(23) is hereby adopted by reference. (Ord. 724 (part), 1995).
9.36.070 Sale or consumption in public places – Permits or licenses refused.
Upon any request for a permit or license of the Washington State Liquor Control Board by any person for sale or consumption of alcoholic beverages in public places, the mayor and/or any other city official answering inquiries by the WSLCB as to whether or not said permit or license shall be granted shall indicate that such permit or license shall not be granted, and shall further indicated to the WSLCB that refusal of said license or permit is an ordained policy of the city council.
