PUBLIC WORKS STANDARDS

16.30.050 Violations – Penalties.
16.30.010 Roads.
The construction of all public and private streets in the city of Pomeroy shall comply with the most recent version of the city of Pomeroy Public Works Standards adopted by resolution of the city of Pomeroy city council. Where required to satisfy a particular grant or funding source, the city may apply such other street construction standards as are required by that grant or funding source, including, but not limited to other state or federal standards. (Ord. 816 §6 (part), 2005).
16.30.020 Stormwater.
The construction of all stormwater management facilities shall comply with the drainage requirements of the city of Pomeroy, and the most recent version of the city of Pomeroy Public Works Standards, adopted by resolution of the city of Pomeroy city council. Where required to satisfy a particular grant or funding source, the city may apply such other stormwater management standards as are required by that grant or funding source, including, but not limited to other state or federal standards. 16.30.030 Sanitary sewer.
The construction of all sanitary sewer facilities shall comply with the most recent version of the city of Pomeroy Public Works Standards, adopted by resolution of the city of Pomeroy city council, and Chapters 246-270 through 246-273 WAC, Sewer Systems, and any other state regulations. Where required to satisfy a particular grant or funding source, the city may apply such other construction standards as are required by that grant or funding source, including, but not limited to other state or federal standards. 16.30.040 Water system.
The construction of all water distribution facilities shall comply with the most recent version of the city of Pomeroy Public Works Standards, adopted by resolution of the city of Pomeroy city council, Chapter 173-160 WAC, Minimum Standards for Construction and Maintenance of Wells, Chapter 246-29 WAC, Public Water Supplies, Chapter 246-292 WAC, Group B Public Water Systems, and any other state regulations. Where required to satisfy a particular grant or funding source, the city may apply such other construction standards as are required by that grant or funding source, including, but not limited to other state or federal standards. 16.30.050 Violations – Penalties.
A. Notwithstanding any provisions to the contrary set forth in any of the Codes adopted pursuant to this chapter, any person firm or corporation who shall violate any of the provisions of this chapter or who shall fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the city council, or by a court of competent jurisdiction, within the time fixed by the provisions of this chapter, shall severally for each and every such violation or noncompliance, be guilty of a misdemeanor, subject to penalty as set forth in Chapter 1.12 PMC, as now exits or as may be hereafter amended. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue. When not otherwise specified, each ten days that prohibited conditions are maintained shall constitute a separate misdemeanor offense.
B. The instigation of misdemeanor proceedings in accordance with subsection (A) of this section shall not prevent the city from exercising all available civil remedies to force removal of prohibited conditions or compliance with this chapter. (Ord. 816 §6 (part), 2005).
