CIVIL SERVICE COMMISSION

2.110.010 Civil service.
A. There is hereby established a civil service commission, consisting of three members serving six-year terms, appointed by the mayor. The first three members of the commission shall be appointed to terms as follows: one to serve for a period of two years, one to serve for a period of four years, and one to serve for a period of six years. Any member of such commission may be removed for incompetency, incompatibility, or dereliction of duty, or malfeasance in office, or other good cause; provided, however, that no member of the commission shall be removed until the charges have been provided, in writing, due notice and a full hearing had by the commission. Two of the members shall constitute a quorum and the affirmative vote of two members shall be required for any action to be taken by the commission.
B. The commission will be responsible for:
1. Making rules for operation of the civil service system that are consistent with the state law.
2. Give practical tests to determine the capacity of persons examined to perform the duties of the positions sought.
3. Conduct hearings and prepare reports.
4. Hear and determine appeals or complaints.
5. Provide for, develop and hold competitive tests to determine relative qualifications of candidates and, as a result of the testing process, prepare eligibility lists.
6. Certify to the appointing authority the name or names of the individuals ranked highest on the eligibility list.
7. Keep records.
8. Approve payrolls.
9. Appoint a secretary and chief examiner.
C. The commission will meet on the second Thursday of each month at ten a.m. at the city of Prosser council chambers. Special meetings of the commission may be called in accordance with the Washington State Open Public Meetings Act.
D. The position of police chief shall be exempt from civil service coverage. The police chief shall have the authority to exclude an additional number of positions, to be designated the unclassified service. The number of such persons who may be designated shall be determined in accordance with the provisions of RCW 41.12.050.
E. The civil service commission shall have all powers and authority available to it under Chapter 41.12 RCW, which is hereby adopted by reference as currently enacted or as hereafter amended or recodified from time to time, and shall be given the same force and effect as if set forth herein in full. 2.110.900 Severability.
If any section, subsection, sentence, clause, paragraph, phrase, or word of this chapter should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or constitutionality of any other section, subsection, sentence, clause, paragraph, phrase or word of this chapter.
