8.36.010 Owner removal required.

The owner of any property within the city is required to, and shall remove or destroy all trees, plants, shrubs or vegetation, or parts thereof, growing, or which has grown and died, upon property owned or occupied by them, or upon the street right-of-way or parking strip abutting such property, overhangs any sidewalk or street, or which grows thereon in such manner as to obstruct or impair the free and full use of the sidewalk or street by the public, or which are a fire hazard, or which may or does clog any sewer pipeline; and to remove and destroy all debris. 8.36.020 Notice.

The proceedings therefor to be initiated by a resolution of the city council, adopted after not less than seven days’ notice served upon the owner or the occupant of the property, or posted in a conspicuous place on the property, which shall describe the property involved and the hazardous condition, and require the owner to make such removal or destruction within ten days after notice is served upon the owner or the occupant of the property, or posted in a conspicuous place on the property, of the adoption of such a resolution. 8.36.030 City removal and cost assessment.

If such removal or destruction is not made by the owner after notice of the adoption of such resolution, the city may cause the removal or destruction thereof, and the cost to the city shall become a charge against the owner of the property and a lien against the property. Notice of the lien shall as nearly as practicable be in substantially the same form filed with the same officer within the same time and manner, and enforced and foreclosed as is provided by law for liens of labor and material. 8.36.040 Provisions supplemental.

The provisions of this chapter are supplemental and additional to any other powers of the city. (Ord. 1220 § 5, 1982).

8.36.050 Violation—Penalty.

Any person who violates this chapter shall be guilty of a misdemeanor, and upon conviction thereof shall be punishable as set forth in Section 1.28.010 of this code. (Ord. 1220 § 6, 1982).
