USE OF RIGHTS-OF-WAY AND DISPLAY LINES

12.36.010 Policy adopted.
The policy regarding the use of city-owned and maintained rights-of-way and display lines is adopted as a policy of the city. (Ord. 1895 § 1, 1996).
12.36.020 Uses and restrictions designated— Procedure.
A. City-owned and maintained rights-of-way and display lines may, upon approval of public works director, only be used for the following:
1. To promote community-sponsored events such as States Day, Balloon Rally, Fourth of July, Wine and Food Fair, Harvest Festival and Sports Fest;
2. To display city banners;
3. To promote significant city activities;
4. To give public recognition for significant community achievements; or
5. Other similar or related purposes.
B. City-owned and maintained rights-of-way and display lines shall not be used by or for the following:
1. Political campaigns, advertisement or promotion;
2. Promotion of private or religious activities;
3. Commercial advertisement; or
4. Other similar or related purposes.
C. Procedure. Prior to the utilization of city-owned and maintained rights-of-way or display lines, those seeking to utilize the same shall obtain permission to do so from the public works director. Applications will be in such form and contain such information as required by the public works director. Permission may be granted on a first come-first serve basis only to those who meet the above criteria.
Any person who has been denied permission may appeal said decision to the Prosser city council. Such appeal must be in writing and filed with the city clerk/finance director’s office within ten days of the denial by the public works director. (Ord. 1895 Exh. A, 1996).
