20.20.010 Purpose.
The purpose of this chapter is to provide for fees and charges for recreation services. (Ord. 2656 § 3, 2009).
20.20.020 Definitions.
“Income” shall have the same meaning as provided for in the USDA’s Eligibility Guidance for School Meals Manual.
“User” or “users” are defined as individuals, groups, civic organizations, business organizations of any nature, charitable organizations, and nonprofit organizations which utilize recreation services. (Ord. 2656 § 4, 2009).
20.20.030 Fees—Refund policy—Late registration fees—Administrative fee setting.
Except as provided for herein fees for recreation programs and facility rentals shall be set by passage of a separate fee ordinance adopted by the city council. The city administrator under the direction of the mayor is authorized to establish a refund fee for recreation fees. Such fee may be charged to users requesting a refund. Such fee may be nothing to the full amount of the fee. The city administrator under the direction of the mayor is authorized to establish policies and procedures regarding late registrations for recreation programs, including but not limited to establishing late registration fees. The city administrator under the direction of the mayor is authorized to establish policies and procedures regarding recreation programs. If there is not a council-adopted fee for a program or use of a facility, then city administrator under the direction of the mayor is authorized to establish fees for programs and enter into rental agreements for recreation facilities with an overall goal of recovering the city’s direct cost for providing recreation programs or the facility. The mayor is authorized to establish policies and procedures to waive fees for low-income applicants and for nonprofit or charitable organizations for recreation programs and facility rentals. 20.20.035 Costs of goods sold at the Aquatic Center.
The mayor, or his designee, is authorized to establish and fix the retail price for goods sold at the Prosser Aquatic Center. The mayor, or his designee, shall not establish or fix a retail price for goods sold, which is less than the cost of the goods sold, except as reasonably necessary to reduce inventory. 20.20.040 Basic services.
The following recreation services shall be provided by the city at no cost to the user: free play in playgrounds; use of city parks or trails for passive recreational uses; use of parks by the public for noncommercial purposes; unscheduled, unlighted, unmarked sports fields; unscheduled outdoor sport courts; unreserved picnic tables and shelters; unreserved playgrounds; public restrooms; and the unreserved and noncommercial use of other park open fields and facilities held open to the general public. 20.20.050 Reduced fees—Scholarships.
A. The city shall provide for reduced fees to users who reside within the city limits of the city as follows providing adequate funding is available:
1. The user must qualify under the “United States Department of Agriculture Child Nutrition Program Income Guidelines,” as they currently exist or as they may be amended in the future. Fees may be reduced up to fifty percent for qualifying individuals or families based upon the individual or family gross yearly income, as computed based on the most current quarter. Any individual qualifying for a partial fee funding level shall pay the unfunded portion of the fee prior to participation. Funding under this policy will only apply to Prosser recreation department sponsored activities.
B. Sponsorships may be solicited by the city from individuals, businesses, service organizations or other organizations to cover all or a portion of the expense for an activity. (Ord. 2689 § 2, 2010: Ord. 2656 § 7, 2009).
20.20.055 Aquatic Center free days.
The mayor, or his or her designee, is authorized to establish times on which the city’s Aquatic Center is open to the public free of charge. During these free times no person shall be charged a fee for the admission to the Aquatic Center. The mayor, or his or her designee, shall inform the city council that the Aquatic Center was open to the public free of charge within thirty days from the date that the Aquatic Center was open to the public free of charge. 20.20.990 Severability.
The provisions of this chapter are hereby declared to be severable. If any section, subsection, sentence, clause, or phrase of this chapter or its application to any person or circumstance is for any reason held to be invalid or unconstitutional, the remainder of this chapter shall not as a result of said section, subsection, sentence, clause, or phrase be held unconstitutional or invalid.
