20.54.000 Freeman Road overlay zone.
The Freeman Road overlay (FRO) zone is hereby established. Properties so designated shall be subject to the provisions of this chapter. (Ord. 3227 § 1, 2021).
20.54.005 Description and purpose.
The FRO is intended to apply to properties designated “Freeman Road overlay” on the city’s official zoning map. The FRO zone is intended to recognize the properties that were analyzed for potential environmental impacts as part of the Freeman Road comprehensive plan map amendment application, Case Number L-20-0001. As part of the environmental analysis completed at the time of the subject map amendment, mitigation measures were identified for screening and buffering between residential and nonresidential uses, as well as additional studies required at the time of a future development proposal(s). 20.54.015 Permitted uses – FRO zones.
Any use permitted or conditionally permitted in the underlying zone. (Ord. 3227 § 1, 2021).
20.54.020 Property development and performance standards – FRO zones.
The intent of this code section is to establish standards for buffering and screening nonresidential uses from existing residential uses in and outside of Puyallup city limits; as such the following standards apply:
(1) The development and performance standards for the particular use and the underlying zone shall apply, except that existing nonconforming single-family residences are subject to those development and performance standards of the RS-06 zone.
(2) Properties that abut Freeman Rd E, which interface with Tribal Trust Land or residential zones in the city of Fife, shall comply with the zone transition standards of PMC 20.26.500 and the city’s Type I landscaping standards, including earthen berm, of the vegetation management standards (VMS). The zone transition standards of PMC 20.26.500 and Type I landscaping standards shall also apply when nonresidential uses are proposed on a property sharing a common boundary with existing residential uses. For the purposes of applying PMC 20.26.500 to the subject properties, the interface with any Tribal Trust Land or MDR (medium density residential) zoning in the city of Fife, or abutting properties containing existing residential uses, shall be considered a “residential zone” or a “RS zone” as referenced in PMC 20.26.500. 20.54.025 Required studies – FRO zones.
At the time of project development review, the following studies are required:
(1) Cultural Resources Study. A cultural resources study shall be provided in accordance with the Washington State Department of Archaeology and Historic Preservation standards for cultural resource reporting. The project proposal shall be reviewed for potential impacts to cultural resources on the project site. At the time of land use permit review, the city development review staff will consult with the Puyallup Tribe of Indians and other affected Tribal nation governments and provide an opportunity to comment, and shall determine whether an archaeologist and/or a cultural resource representative from affected Tribal governments, as well as any other recommendations from the cultural resources report, is warranted during ground disturbance activities. Any condition based on Tribal comments shall be communicated to the applicant before or during the pre-construction meeting. In the event of discovery of any archaeological resource during site construction, the applicant shall comply with the requirements of Chapter 27.53 RCW.
(2) Traffic Impact Analysis. Traffic impact analysis shall be required to evaluate the project’s impacts to Freeman Rd E and the transportation system within the vicinity of the project site. The traffic impact analysis shall evaluate the roadway improvements necessary to accommodate the proposed use (e.g., roadway width, pavement conditions, rail crossing design, public safety improvements and any other design challenges, etc.). The city of Fife, the Puyallup Tribe of Indians and Union Pacific Railroad shall be consulted on future development proposals and subject traffic impact analysis report(s). The requirement of traffic impact analysis for an individual development proposal may be waived if agreed upon by the city of Puyallup, city of Fife, and the Puyallup Tribe of Indians.
