9.50.010 Keeping of disorderly house prohibited.
It shall be unlawful for any person who owns, leases, operates or is otherwise in control of any premises to willfully make or continue, or cause to be made or continued, any loud or unusual noise which disturbs the peace or quiet of any reasonable person of normal sensitiveness residing in the area. (Ord. 16-146 § 1).
9.50.020 Standards.
The standards which shall be considered in determining whether a violation of this chapter exists shall include, but not be limited to, any one or more of the following:
A. The volume of noise;
B. The intensity of the noise;
C. Whether the nature of the noise is usual or unusual;
D. Whether the origin of a noise is natural or unnatural;
E. The proximity of the noise to residential sleeping facilities;
F. The density of the inhabitation of the area within which the noise emanates;
G. The time of the day or night the noise occurs;
H. The duration of the noise; and
I. Whether the noise is recurrent, intermittent or constant. (Ord. 16-146 § 1).
9.50.030 Civil infraction penalty.
Any person who violates the provisions of this chapter shall be guilty of a civil infraction punishable by a monetary penalty in an amount not to exceed $500.00. Each hour of each day that a person violates the provisions of this chapter shall constitute a separate civil infraction and shall subject the person to a separate monetary penalty. (Ord. 16-146 § 1).
