15.38.010 Purpose and application.

The purpose for adopting the trailer park rules and regulations as set forth in this chapter is to provide a framework and a set of rules and regulations under which the city shall govern, operate and control in the interests of public health, safety and welfare all city-owned trailer parks. 15.38.020 Rules and regulations.

A. The rules and regulations set forth in this chapter are applicable to all tenants renting or leasing lots or spaces in city-owned trailer parks. Specific written leases with specific tenants may contain terms of tenancy in addition to these rules and regulations.

B. The following rules shall apply in all city-owned trailer parks:

1. Except as permitted herein, all tenants shall execute written annual one-year mobile home lot rental agreements in a form approved by the city council. Tenants who desire to occupy a Rock Island trailer park lot for other than a term of one year may request a written rental agreement on a month-to-month basis, but must waive, in writing, the right to such one-year term. Tenants refusing to execute a written rental agreement shall be in violation of this rule and subject to eviction by the city pursuant to RCW 59.20.080 as now exists or as may be hereafter amended.

2. All mobile home owners must obtain written permission from the city before mobile homes are installed or removed from the park.

3. All mobile homes shall be skirted to meet city ordinances.

4. Loud and unusual noises are prohibited at all times. TV, stereo, radio and other amplified sound systems must be kept at a low volume between 10:00 p.m. and 8:00 a.m.

5. Tampering with water, sewer, electric or gas connections is prohibited.

6. Heat tape should be installed by the tenants and maintained in working conditions during freezing weather.

7. Tenants are responsible for the actions of their guests.

8. No major repairs shall be performed on motor vehicles inside the trailer park.

9. Trailer park space numbers will be placed in a visible place on all units.

10. Children shall not play in the street areas located within the trailer park. Children shall not play in the space of other tenants without the specific permission of the tenant. Parents shall be financially responsible for any damage done by their children to private or public property.

11. All dogs must be leashed or penned and licensed and shall not be permitted to run loose.

12. Tenants shall comply with the city’s mandatory garbage pickup Ordinance No. 98-012, as it now exists or as may be hereafter amended, and shall place garbage collection containers by the curb in front of each lot on designated garbage pickup day.

13. Tenants shall keep their leased space and improvements thereon in a clean and sanitary condition.

14. The storing of hazardous waste or chemicals shall not be permitted in the trailer park.

15. Tenants shall properly dispose of all rubbish, garbage and other organic or flammable waste at reasonable and regular intervals and shall assume the cost of extermination and fumigation for all infestation caused by tenant.

16. Tenants shall mow and water the grass and lawn area in their space and keep the grass, lawn, flowers and shrubbery in their space in good order and condition and keep the sidewalk abutting their space free and clear of all obstructions, snow and ice.

17. Tenants shall not stockpile any materials on their lot and shall keep their lot free from excessive or unsightly personal property.

18. No more than two tenant-owned or leased passenger vehicles may be parked on or at each lot. Each such vehicle shall be registered with the city clerk. Tenants may not store or park any other vehicle within the park. For purposes of this section, “passenger vehicles” means currently licensed and operable sedans or light trucks used for noncommercial purposes.

19. No pleasure vehicles may be parked between the hours of 10:00 p.m. and 6:00 a.m. within the park. For purposes of this section, “pleasure vehicle” means and includes any motor vehicle or trailer designed and used as a travel trailer, camper, motorhome, tent trailer, boat, boat trailer, snowmobile, snowmobile trailer, motorcycle trailer, camping trailer, utility trailer, and any other device towed by or used in conjunction with a motor vehicle, and any other similar devices.

20. Except as provided by RCW 59.20.073 and 59.20.145, as each exists now or may be hereafter amended, or as otherwise required by statute or authorized by the city council, no tenant or occupant of the trailer park shall assign the rental agreement, sublet the premises, give accommodations to any roomers or lodgers, or permit the premises to be used for any purpose other than a private dwelling solely for the tenant and/or the tenant’s family. 15.38.030 Civil infraction.

Any individual violating the rules and regulations for city-owned trailer parks set forth in this chapter shall be guilty of a civil infraction, and upon conviction thereof may be assessed a monetary penalty of up to $250.00 for each such civil infraction. The civil infraction penalty provided for herein is not an exclusive penalty and violators of the trailer park rules and regulations may in addition be subject to criminal prosecution, enforcement of state statutes and enforcement of provisions in trailer park leases executed by tenants.
