8.05.010 Purpose.

The Roslyn city council recognizes that there are inordinately high risks to public health and safety within the city limits of Roslyn due to fire hazards resulting from the sale and discharge of fireworks.

It is necessary to protect the public health and safety by limiting the days upon which the sale of fireworks can occur and limiting the time during which said fireworks may be ignited. [Ord. 765 § 1, 1994.]

8.05.020 Definition.

“Fireworks” means any composition or device, in a finished state, containing any combustible or explosive substance for the purpose of producing a visible or audible effect by combustion, explosion, deflagration, or detonation, and classified as common or special fireworks as defined in Chapter 70.77 RCW. [Ord. 765 § 1, 1994.]

8.05.030 Prohibition against discharge.

The city of Roslyn prohibits the ignition or discharge of fireworks within the city limits of Roslyn except between the hours of 9:00 a.m. and 11:59 p.m. on Winter Solstice and on December 31st each year. [Ord. 1045 § 1, 2008; Ord. 976 § 1, 2005; Ord. 765 § 1, 1994.]

8.05.040 Sale limits.

The city of Roslyn limits the sale of fireworks within the city limits of Roslyn prior to 9:00 a.m. on July 1st or after 11:00 p.m. on July 4th each year commencing in the year of 1994. [Ord. 765 § 1, 1994.]

8.05.050 Penalty.

Any person violating the provisions of this chapter is guilty of a misdemeanor and upon conviction shall be punished by a fine of not more than $1,000 and by imprisonment for not more than 90 days, or by both such fine and imprisonment. [Ord. 765 § 1, 1994.]
