NUCLEAR WEAPONS-FREE ZONE

8.08.010 Declaration.
San Juan County is and shall remain a nuclear weapons-free zone. (Res. 40-1984 § 1)
8.08.020 Definitions.
For the purpose of this chapter the following definitions apply:
“Component of a nuclear weapon” means any device which would be incorporated into the structure of a nuclear weapon.
“Nuclear weapon” means bombs or other warheads which derive their force from either the fission or fusion of atomic nuclei. (Res. 40-1984 § 2)
8.08.030 Unlawful activities.
It is unlawful for any person, firm, corporation or governmental body to possess, use, test, deploy or store nuclear weapons, or to manufacture components whose sole purpose is use in the production of nuclear weapons, within County boundaries. (Res. 40-1984 § 2)
8.08.040 Violation – Abatement.
Any violation of this chapter is declared to be a public nuisance. In seeking compliance with the provisions of this chapter the prosecuting attorney may utilize the most effective means available including, but not limited to, one or more of the following:
A. Injunction;
B. Proceedings for abatement, removal and enjoinment in the manner provided by law;
C. Such other steps as will abate, restrain and enjoin any person, firm, corporation or governmental body from violating the provisions of this chapter. (Res. 40-1984 § 3)
