OFFICERS’ OATHS AND BONDS

2.16.010 Purpose.
This chapter designates the city officers who must take an oath or affirmation of office, and establishes a requirement for performance bonds, both in accordance with RCW 35A.13.160 and 35A.12.080. (Ord. 2022-008 § 1 (Exh. A); Ord. 2009-036 § 1; Ord. 2009-027; Ord. 492 § 1, 1986)
2.16.020 Oaths required – Bonds designated.
A. Oaths Required. Persons hired to the office of city manager of Sequim are required to take an oath or affirmation for the faithful performance of their duties. The oath or affirmation will be posted on the official website. Interim or acting city managers who are expected to hold the position for longer than 90 calendar days may be required to take an oath of office which will be posted on the website.
Oaths or affirmations will be given by the mayor or the mayor’s designee and will be in the following or substantially similar form:

I ____ solemnly swear (or affirm) that I will faithfully and impartially to the best of my ability perform the duties of the office of City Manager, and that I will support and defend the Constitutions of the United States and the State of Washington, the applicable laws of the United States and the State of Washington, and all other duly enacted laws, rules, and policies of the City of Sequim, Clallam County, Washington.

B. Bonds Designated. Before performance of their duties, the city clerk, the administrative services director, the chief of police, and the city manager, and any persons occupying those positions on an acting or interim basis, must be covered by a performance bond or equivalent coverage provided by an insurance policy or municipal risk pool.
C. Bonds must be conditioned in such penal sums for the faithful performance of the officers’ respective duties and include provision for the faithful performance of all offices and duties of which each such officer is by law made ex officio incumbent.
D. In the event of the combination of any of the offices pursuant to law, a single bond may be provided.
E. A policy of insurance or equivalent coverage through a municipal risk pool that requires honest and faithful performance and insures against the same perils as a bond may be utilized in lieu of a bond. (Ord. 2022-008 § 1 (Exh. A); Ord. 2009-036 § 1; Ord. 2009-027; Ord. 492 § 2, 1986)
2.16.030 City to pay premiums for bonds or equivalent coverage.
The city will pay all premiums for bonds for the city officers, or for such insurance policy or risk pool coverage that is used in lieu of bonds to effect the purposes of this chapter. (Ord. 2022-008 § 1 (Exh. A); Ord. 2009-036 § 1; Ord. 2009-027; Ord. 492 § 3, 1986)
